TVGs processed against Planning Inspectorate opinion

The request was successful.

Dear Blackpool Borough Council,

Under the Freedom of Information Act I request the following information:

1. How many Town and Village Green (TVG) applications has this local authority (LA) dealt with since 19 July 2006. Or if this not possible to obtain then the best you can do, but please specify the period of the search.

2. Of these TVG applications returned in 1, for how many was the Planning Inspectorate's opinion that the TVG application was excluded? In other words that a trigger event had occurred with no closing event.

3. Of these TVG applications returned in 2, for how many did the processing of the TVG application continue, in other words the LA ignored the Planning Inspectorate's opinion that any TVG application was excluded.

4. For the TVG applications returned in 3, please supply details of location, LA decision on the application and any appeal details i.e. court reference and outcome.

Electronic versions of documents are acceptable and preferred.

Thanks

Yours faithfully,

Malcolm Reeves

You should note that the Act defines a number of exemptions that may prevent disclosure of the information you have requested.  If any of the exemption categories apply, the information will not be disclosed.  If there are references to a third party, they may be consulted prior to a decision being made on whether or not to disclose the information.  You will be informed if either of these is applicable, including your rights of appeal.

There may be a fee payable for this information.  If this is the case, you will be informed in writing and a ‘Fees Notice’ will be issued.  The fee must be paid before the information is processed and disclosed.  The 20 working day time limit for responses will commence on receipt of the payment if a fee is applicable.

Dear FOI,

You have told me to look under planning applications but the dealing with a Town or Village Green application and registering of greens and common land is not usually a planning function but is typically done by rights of way department. I do not believe the link you have provide at all answers my request.

I would therefore ask that you look again at my request or explain how planning search can be used to find application for entry into the commons register as a new green.

If you are unwilling to do this then please consider this email a request for a review of this FOI request.

Yours sincerely,

Malcolm Reeves

Dear Blackpool Borough Council,

May I remind you that by law you are required to respond promptly and by 14 Sept 2020 (20 days). I realise that we are in Covid times but many other authorities have managed to reply and well within 20 days.

Dear Mr Reeves

Thank you for your email below.

I have made further checks on this FOI request and I am now able to advise
that -

Since 19th July 2006  the Council has dealt with no Town or Village Green
applications.

I trust that this now answers your request.

Kind Regards
