I am making this request under the terms of the Freedom of Information (Scotland) Act 2002.

This request only relates to information held by Glasgow Sheriff and Edinburgh Sheriff Courts since 1st January 2011.

Please provide me with the following information:

1. The number of search warrant applications made by employees of the BBC/TV Licensing/Capita Business Services Ltd in accordance with Section 366 of the Communications Act 2003.
2. Of those applications, the number granted or refused.
3. Of those applications granted, the number with information laid to the effect that detection/detector van evidence had been (allegedly) obtained by the BBC/TV Licensing/Capita Business Services Ltd.

HMCTS has previously released similar information under the terms of the Freedom of Information Act 2000 (their ref: FOI/86722), so I trust the Scottish Court Service will have no difficulties in doing the same.

Thank you very much for your timely and efficient handling of my request. It is very much appreciated.

I wonder if you'd be kind enough to help with a small follow-up point. As you may have noticed, several colleagues have placed similar Freedom of Information requests, about TV Licensing search warrants applications to various Sheriff Courts, over the last couple of weeks.

The responses received so far have all said the same thing: The Scottish Court Service has "no record of any such applications being lodged" with the courts in question. This includes several Sheriff Courts covering large urban areas including those in Glasgow, Edinburgh, Aberdeen and Dundee.

Given the massive population served by these courts, the negative responses provided came as somewhat of a surprise.

Can you please just confirm that had TV Licensing actually made any relevant search warrant applications, those would have definitely been thrown up in your search of the court records/information?

Dear Mr Jones

I can confirm that such application would be recorded in the Miscellaneous Application Register held at each court or their Utility Warrant Register and would be found be searching on a variant of the names you have provided. The only exception to this would be search warrants that had been applied for out of office hours. These would not be recorded on the registers held by the Sheriff Clerk but we cannot envisage such an application ever being so urgent as to merit such an application.
