TV Licensing Enforcement
Dear Sirs,
Pursuant to the general right of access to information contained in Section 1 of the Freedom of Information Act 2000 I request the following information held by the BBC:
(1) the full content of all standard operating procedures in respect of the BBCs enforcement powers under the Communications Act 2003 in respect of the requirement to hold a TV license as it pertains to the jurisdiction of the law of Scotland only.
(2) the number of warrants (i) applied for and (ii) granted under section 366 of the Communications Act 2003 to date in the calendar year of 2015 in (a) The Sheriffdom of Glasgow and Strathkelvin; (b) The Sheriffdom of Grampian Highland and Islands; (C) The Sheriffdom of Lothian and Borders; (d) The Sheriffdom of North Strathclyde; (e) The Sheriffdom of South Strathclyde, Dumfries and Galloway; and (f) The Sheriffdom of Tayside, Central and Fife

I can help you a bit with this Alistair, as my blog did research into the number of s.368 warrants granted in Scotland. As at July 2014 none of the Scottish Sheriff Courts had issued one of these warrants in the past 3 years. As you're probably aware, the evidential standards are much higher in Scotland. This deters TV Licensing from wheeling out half the tosh it does in the English/Welsh Magistrates' Court, where its evidence will be less robustly analysed. The BBC won't provide the information requested, so our tact was to contact the Scottish Court Service instead.
