TV Licence Requirements: Radio Reception via Television Equipment

Dear British Broadcasting Corporation,

I am making this request for information under the terms of the Freedom of Information Act 2000.

Background information:
The BBC has previously admitted (RFI20080234): "You do not need a TV licence if you only use a TV to listen to digital radio broadcasts and not to watch or record television programmes as they are being shown."

TV Licensing recently confirmed their agreement with the above statement (TVL reference: 523312). They also confirmed that legitimate non-TV licence holders were under no legal obligation to to modify (and potentially damage) their equipment to render it incapable of receiving/recording a live TV signal.

My request:
Please provide me with copies of all BBC/TV Licensing produced documents relating to the TV licensing requirements of properties where TV equipment is installed/used to listen to radio broadcasts only.

Presumably the BBC's previous response to RFI20080234 was based on some policy document. Please provide a copy of that document.

I look forward to a timely and complete disclosure in accordance with the spirit of the Act.

Thanks op. Really useful . This means I could use a £10 digibox to listen to 1xtra. No need spending hundreds on new stereo!

Be careful though, as some bbc radio stations stream and broadcast webcam feeds on their digital channels therefore you're watching the radio if via a tv... ;) bit of a fix eh. Excellent reason to break out that old sky box most of us have.
