Data Protection, Trafford Metropolitan Borough Council

Dear Ms Turnbull

Thank you for your email of the 4th March 2018 where you requested
information about

"Copies of Trafford council internal emails dated between 12 February 2018
and 28 February 2018 inclusive, in relation to  this planning application
and associated consultation.

Copies of recorded communications on the same subject and for the same
dates, between Trafford Council's staff and/or councillors, to or from
Gary Neville, or representatives of Salford City FC, or representatives of
UA92."

Every search on the system under the keywords ‘planning application
93628/FUL/18’, ‘Gary Neville’, ‘Salford City FC’, ‘Turn Moss’ and ‘UA92’
is bringing up emails in excess of 1000.

Section 12(1) of FOIA allows a public authority to refuse to deal with a
request where it estimates that it would exceed the appropriate limit to:
either comply with the request in its entirety or confirm or deny whether
the requested information is held. The estimate must be reasonable in the
circumstances of the case. The appropriate limit is currently £450 for all
local authorities. All public authorities should calculate the time spent
on the permitted activities at the flat rate of £25 per person, per hour.
The time and resource anticipated in answering this part of the question
is in excess of 18 hours due to the volume of emails that have been
highlighted in the search. If you are able to re-define your request more
specifically, it may be possible to provide the information you require
without exceeding this threshold. If you require any advice or assistance
in doing this, please do not hesitate to contact us. Therefore, due to the
excessive time and resource required in providing a response to your FOI,
the above exemption under Section 12(1) would apply.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to: Information Governance
Manager, Trafford Council, Town Hall, Talbot Road StretfordM33 0TH or via
email to [1][Trafford Council request email]

Please remember to quote the reference number above in any future
communications.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted at: Information
Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9
5AF

The supply of information in response to a freedom of information request
does not confer an automatic right to re-use the information.  Under UK
copyright law you can use any information supplied for the purposes of
private study and non-commercial research without requiring permission.
Similarly, information supplied can also be re-used for the purposes of
news reporting. An exception to this is photographs.
For other forms of re-use, for example publishing the information, you
would need the permission of the organisation or person who owns the
