Dear Mr Collis,

REF: Freedom of Information Request - FOIA0728

The University has completed its search for the information requested by
you under the Freedom of Information Act.

Having carefully considered your request, the University is of the view
that the requested information is exempt from disclosure under the
exemption available at section 22 of the FOIA.  Under Section 22, a public
authority may refuse to disclose information to the extent that the
request involves disclosure of information which is intended for future
publication.  Section 22(1) states that information is exempt information
if the information is held by the public authority with a view to its
publication, by the authority or any other person, at some future date
(whether determined or not), and  if it is reasonable in all the
circumstances that the information should be withheld from disclosure
until the publication.

Section 22 is a qualified exemption which requires consideration of the
public interest.  In applying this exemption the University had to balance
the public interest in withholding the information against the public
interest in disclosure.  The public interest test has been applied as
follows:

Factors in favour of disclosure

Promoting transparency and accountability.

Factors in favour of withholding disclosure

-       Providing the information to you now would cause disruption to the
planning schedule, causing disruption to staff involved in the publishing
of the document.

-       The information has yet to be finalised (before publication)
because the information hasn’t been approved yet.

-        Any inaccuracies at the draft stages may result in misleading the
general public.

The public interest in withholding the requested information outweighs the
public interest in releasing the information in the public domain.

If you are unhappy with the service you have received in relation to your
request and wish to make a complaint or request a review of our decision,
you should write to the Information Governance Unit, Coventry University,
Alan Berry Building, Priory Street, Coventry, CV1 5FB or email
[Coventry University request email].

If you believe that the University has not dealt with your request in
accordance with the FOIA, please be advised that you have the right to
have this decision reviewed via the University’s complaints procedure, a
copy of which can be provided upon request.

If you are not content with the outcome of your complaint, you may apply
directly to the Information Commissioner for a decision.  Generally, the
ICO cannot make a decision unless you have exhausted the complaints
procedure provided by the University.  The Information Commissioner can be
contacted at: The Information Commissioner’s Office, Wycliffe House, Water
Lane, Wilmslow, Cheshire SK9 5AF; Tel: 01625 545 745; Email:
