Dear Mr Wilson
Thank you for your email of 4 March 2021, in which you ask for details of
an interim order application hearing.
Your request has been handled under the Freedom of Information Act 2000
(FOIA).
On 10 February 2021, an Investigating Committee Panel determined that Mr
Dunwell be suspended from the HCPC Register on an interim basis for a
period of 18 months. The interim order application hearing was heard
entirely in private. We are therefore unable to release the transcript or
any further details as we consider that it is the personal data of Mr
Dunwell and as such is exempt from disclosure under Section 40(2) of the
FOIA. Further information on this exemption is provided below.
Section 40(2)
This exemption applies to personal data which relates to a third party.
Disclosure of this information would breach the principles of data
protection set out in Article 5(1) of the UK General Data Protection
Regulation (UK GDPR), in particular principle (a) that personal data
should be processed fairly and lawfully. Mr Dunwell would not reasonably
expect that we would further disclose the transcript or other further
details of his hearing for non-regulatory purposes. If the HCPC were to do
so it would be unfair processing, this would not be lawful.
