Tree felling in a conservation area, namely Penzance Market Place

Dear Cornwall Council,
In relation to the tree that was felled around the time of 20th January 2011 at the bottom of Causewayhead, Penzance.
I request the following information.

1) As this is a conservation area, why did the council not give notice or prior warning of the said tree felling?
2) As it is a legal requirement to inform the public of a tree felling,and the council did not do this, will the council be prosecuted-as a member of the public would have been in the same circumstances?
3) Following on from the annual tree inspection in August 2010 that found the tree to be '95% dead', could I see a copy of that inspection report and the name of the tree inspector?
4) If the tree was 95% dead in August 2010, why was it not felled straight away?
5) Which of our local elected representatives were informed prior to the tree being felled?

I'm still confused. All the legal talk seems to justify the felling, legal talk always 'justifies'.
The issue of not informing the public prior to felling and assuming the upper hand still prevails.
But sadly, perhaps that will always be the case????
