FREEDOM OF INFORMATION REQUEST
Further to my previous three requests remaining un-acknowledged and awaiting response.
Requests sent within Stage 1-3 Complaints (Your ref HO1048), dated sequentially 28-08-2012, 28-10-2012 and 13-12-2012.
I request for the fourth time the following information.
1) The total units of trees, with total expenditure within the Potters Bar Estate area, that were maintained (pruned), since your formation (Enfield Homes, Almo) 2008 to December 2012.
2) The total units, with total expenditure of trees within the Potters Bar Estate area, that were destroyed, felled during the period between your formation 2008 to December 2012.
Further Freedom Of Information Requested Today.
3) The number of trees designated for destruction within the Potters Bar estate area following your contracted tree survey 2012.
4). All information pertaining with your expenditure. Relating to the 2012 Hertfordshire Highways trees land work already contracted and completed by Enfield Homes, this within Hertfordshire Highways land, being the verges A1000 & B556 Mutton Lane, Potters Bar. Hertfordshire confirming your presence since November 2012 is subject to ancient land claim of Middlesex, as of yet still not substantiated by land records, or confirmed by Mr Warby, Asst Asset Manager, Hertfordshire Council..
5) Information regarding your Land claim of current Hertfordshire land, remaining as always was, being still fully serviced by Hertsmere or Hertfordshire councils. With no records of historical evidence, that Enfield council have ever had any previous title or involvement with whatsoever. D.Rodwell

Response to part 3
Tree Inventory and Hazard Evaluation Survey conducted across all LBE owned
Housing classified land between Sept 2011 and Sept 2012, identified that a
total of -
101 Individual Trees and 7 Groups of trees across the entirety of the
Ashwood Road Estate, Potters Bar.
- of which 26 individual trees and 5 groups are located in individual
rear gardens, 75 individual trees and 2 groups are located in front
gardens or communal land
of the 101 Individual Trees - 68 have been identified as requiring
no work
7 have
been identified to be dead/dying and require felling -
of which 2 were felled on 21/09/12 at a cost of £288.89
26 have
been identified as requiring maintenance works -
of which 7 were carried out over the 21/9/12 and 26/10/12 at a cost of
£1011.11
of the 7 Groups of trees - 6 have been identified as requiring
no work
1 has been
identified as requiring maintenance works.
Response to part 4
Total 25 individual trees identified as being located within the
greenswards to the North of the estate adjacent Mutton Lane and the east
of the estate adjacent Barnet Road
of which -
13 have been identified as requiring no work
11 have been identified as requiring maintenance works -
of which 6 were carried out over the 21/9/12 and 26/10/12 at
a cost of £866.70
1 has been identified as being dead and required felling -
works were carried out on 21/09/12 at a cost of £144.45
Response to part 5
It is assumed that this part relates to the greenswards aforementioned in
part 4 -
We can confirm that land ownership was transferred to the London Borough
of Enfield on 13th June 1955, and both areas of greensward are included
and remain wholly owned by LBE.
We advise however that Public Adoption for Highways purposes does
supersede land ownership, with resulting responsibility for any
maintenance of adopted land passing to the adopting Highways Authority.
Clarification will therefore be required from Herts. CC as to extent of
Public Adoption

Or perhaps there was there was no maintenance (tree care) at all carried out during this period, within the specified area?
Part 5.
You have not provided any data of your claimed historical claimed land title, or legal support documents or data confirming your alleged entitlement (agreed permission) for Enfield’s tree care expenditure, within the already existing fully multi- serviced land by Hertfordshire Highways expenditure boundaries.
Also outstanding are all the communications forwarded from Enfield Homes to Hertfordshire CC, and their responses, for you to be granted permission for tree work within Hertfordshire boundaries. This commencing and only beginning in the year 2012, and following on from the previous 55 years (when estate built) of no involvement whatsoever within the already fully serviced Hertfordshire land, being provided by Hertfordshire and Hertsmere councils only, that still is continuing as of today.

I note the reason for your review request as per the two items below:
1. Failing to correctly respond to issuing email, without any
evidence of any email or site technical problems recorded, or known by
WhatDoYouKnow.
2. Withholding part information not provided within original FOI
request, and having been subsequently re-requested, without any response
or acknowledgement. Matter now overdue by 17 days.
Item 1
I note from investigation that a response to your FOI was rejected by
“WhatDoYouKnow FOI #155319” on the 29^th April 2013 as advised to you by
Mr Horgan in his email to your personal address on the same day, and
subsequently reconfirmed to you on the 7^th May. I note that your email of
8^th May confirms receipt of Mr Horgan’s response. As the originating
email address could not be responded to, and to ensure that you received
the information requested, your personal email address was used. I attach
the “undeliverable report” received by Mr Horgan from “WhatDoYouKnow”.
I consider that whilst you advise that “WhatDoYouknow” have no recorded
technical problems, there clearly has been a problem using this address
and Mr Horgan’s actions of bringing the response to your attention through
your personal email address were of the best intentions and in your best
interest in the objective of receiving a response to your FOI.
Item 2
I refer to you email of 12^th May as reference to the information alleged
by yourself as outstanding or withheld, noted below;

This commencing and only beginning in the year 2012, and following

Part 1 and 5 of your request was responded to by Mr Horgan in his email of
the 29^th April, outlined below:

Having reviewed the information provided by Mr Horgan I consider it
responds appropriately to your request.
Part 5 response Mr Horgan wrote
“We can confirm that land ownership was transferred to the London Borough

Since Mr Horgan wrote to you we have now received Land Registry
documentation from Herts CC of LBE land title since 1955 which I have
attached. Please note that the register refers to a map which owing to its
size (A1) we have been unable to scan. Should you wish to view the map
please contact Mr Horgan who will arrange a mutually convenient time to
view the map at our offices in Edmonton Green. As the land is in LBE
ownership there is no communication relating to permission from Herts CC
to undertake maintenance.
I consider that the above information satisfactorily responds to your
request.
Review Outcome
With the exception of further information being received from Herts CC in
relation to title of the land in question, at the time of the response I
consider that all information available for release within the scope of
your request has been provided. Whilst it is unfortunate that the desired
target response to What do they know could not be achieved in the first
instance, the information was provided to an alternate email destination
with confirmed receipt by yourself, fulfilling the objectives of the
request. I can find no significant fault with the handling and response of
your FOI request on this occasion.

Enfield Council has partly omitted vital requested data information as requested.
Still outstanding is the confirmation of any maintenance (care protection) of trees within the Potters Bar estate, during the period 2008 to 2012.
With a record number of now felled trees completed, the information sought was vital, but has been denied.
