Travel Repayments from Cllrs to NYCC

The request was successful.

Dear North Yorkshire County Council,

A 'Conservative Away Day' meeting took place on the 17th October 2011 at the 'Leeming Bar Hotel'. After perusing the mileage sheets of one County Cllr it became apparent he should not have claimed any travel costs for this journey and has subsequently repaid the money to NYCC.

Please can you confirm by name, which Conservative County Cllrs claimed travel costs to attend this meeting, which Conservative County Cllrs have repaid the travel costs and which Conservative County Cllrs have yet to repay the travel costs.

Yours faithfully,
Tim Thorne

Dear Mr Thorne,

Thank you for your Freedom of Information request.

Please find the response to your request below.

"A 'Conservative Away Day' meeting took place on the 17th October 2011 at
the 'Leeming Bar Hotel'. After perusing the mileage sheets of one County
Cllr it became apparent he should not have claimed any travel costs for
this journey and has subsequently repaid the money to NYCC.

Please can you confirm by name, which Conservative County Cllrs claimed
travel costs to attend this meeting, which Conservative County Cllrs have
repaid the travel costs and which Conservative County Cllrs have yet to
repay the travel costs."

We do not have information as to how many other Councillors attended the
meeting. Three other Members claimed, and the expenses are being recouped.
They cannot be identified as this information constitutes their personal
data and is, as such, considered exempt under Section 40(2) where
disclosure would contravene one or more of the principles of the Data
Protection Act ("DPA"). In this case we consider that disclosure of this
information would breach the first principle of the DPA that requires that
the processing of personal data be fair and lawful, and only be processed
if one of the conditions in Schedule 2 of the DPA is met. In this case the
disclosure would be unfair and unlawful and none of the conditions of
disclosure have been met.

Please find attached the Council's appeals procedure.

Dear Data Management Officer,

I am writing to request an internal review of 'Travel Repayments from Cllrs to NYCC' FOI request.

I believe that the Council should have released the names of the three Councillors who are being asked to repay mileage and NYCC are incorrect in their assessment. I firmly believe it is in the public interest to disclose this information.

Yours sincerely,
Tim Thorne
