I made the following request to GLA and they have answered part 1 (which is below) and suggest I request TFL to answer parts 2, 3 & 4 as they do not hold the information. The questions were:-

As part of the Shared Services agenda staff from GLA joined TFL. This included
staff in Finance, Procurement and legal services. I would like to know the
following information:-

How many staff transferred to TFL?
Of those how many retain GLA employment Terms and Conditions?
How many staff have received a payment to transfer to TFL T&Cs?
For staff who entered at TFL structure Band 3 and 4 what was their Band at
GLA?

Unfortunately, from the description provided, we are unable to identify
the information you require.

 

To enable us to assist with your request please confirm the length of
period you wish to go back to. 

Did GLA provide you with how far back they went when providing the answer
to your first point?

Could you clarify if you are referring to GLA solely or you are referring
to other bodies that were aligned to GLA for example LLDC?

 

 

The Freedom of Information Act allows you to request recorded information
held by Transport for London. There are limits on the time that we are
required to spend determining whether we hold the information you are
requesting and the time spent locating, retrieving and extracting it.
Therefore you should identify the information that you want as clearly and
concisely as you can, specifying the types of document that you are
looking for. You might also consider limiting your request to a particular
period of time, geographical area or specific departments of the
organisation.

 

Although your request can take the form of a question, rather than a
request for specific documents, we do not have to answer your question if
it would require the creation of new information or the provision of a
judgement, explanation, advice or opinion that was not already recorded at

Unfortunately, to provide the information you have requested would exceed
the ‘appropriate limit’ of £450 set by the Freedom of Information
(Appropriate Limit and Fees) Regulations 2004.

 

Under section 12 of the FOI Act, we are not obliged to comply with a
request if we estimate that the cost of determining whether we hold the
information, locating and retrieving it and extracting it from other
information would exceed the appropriate limit. This is calculated at £25
per hour for every hour spent on the activities described.

 

Answering the request would significantly exceed the appropriate limit
because of its scope. We do not have a system that is capable of reporting
on what company each person has TUPE transferred from and to manually
review all information held since 2009 would take an excessive amount of
time.

 

To help bring the cost of responding to your request within the £450
limit, you may wish to consider narrowing its scope so that we can more
easily locate, retrieve and extract the information you are seeking. If
you want to refine your request or make a Freedom of Information Act
request in future, please bear in mind that the Freedom of Information Act
allows you to request recorded information held by us. You should identify
the information that you want as clearly and concisely as you can,
specifying the types of document that you are looking for. You might also
consider limiting your request to a particular period of time, or specific
departments of the organisation.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Transport for London's handling of my FOI request 'Transfer of staff from GLA to TFL'.

The reasons for an internal review are as follows:-

I have been very understanding and reduced the number of people I have asked for information on, removing Finance staff. This was on your recommendation. If this was your recommendation surely you know which staff I am asking information on.

GLA were able to identify the number of staff that moved from GLA to TFL under this policy. Surely this was managed as a project and the project would have identified the staff involved. TFL must have this information.

With this information you can identify each person, check their grade and answer my questions quite easily. Statistically we are talking about 3 or 4 staff.

As part of the Internal Review I would also like you to undertake a review of the whole handling and timeliness in dealing with my request. At no stage have I felt you have helped in providing the information requested.

This review has been carried out by an independent panel following your
e-mail of 28 April 2017 regarding the response to your request for
information under the Freedom of Information (FOI) Act. The review was
carried out by an independent Review Panel (‘the Panel’) consisting of
individuals who were not involved in the handling of your request. The
panel apologise for the delay in answering your request for internal
review.

 

Your initial request of 30 January 2017 for information asked:

This request was refused under section 12 as it would exceed the
appropriate limit. Your request was refined on 19 March 2017 to just
include Procurement and Finance staff.

 

A response was issued to you on 8 April 2017 and stated that we could not
provide you with the requested information as we were not able to identify
the seven members of staff caught by your request.

 

The Panel have reviewed the handling of your original request
(FOI-2677-1617) and have concluded that we did not hold the information
that would have allowed us to respond to your request within the
appropriate limit. As stated in our response, ‘we are not able to report
on which company or organisation an individual was TUPED from, as this
information is not recorded on our systems.’ However, as the GLA would not
disclose the names of these seven members of staff to a member of the
public as it would be a breach of the Data Protection Act, we have made an
exception in this instance and requested the names from them. We have been
able to identify 16 of the 17 members of staff that transferred from the
GLA. Please find the requested information below:

One person has remained on the GLA’s Terms & Conditions.

 

How many staff have received a payment to transfer to TFL T&Cs?

 

We do not hold this information as we do not have a record of staff
receiving payments to be on TfL’s T&Cs. The only record we hold is the
salary they TUPED to TfL on.

 

For staff who entered at TFL structure Band 3 and 4 what was their Band at
GLA?

 

We do not hold information on the band they would have been on at the GLA,
the bands given below are the bands they were put into once they TUPED to
TfL:

 

8 staff TUPED to Legal
