Ref: BA/2014/0195/Ful - BA/2015/0277/FUL - Broadholme

Please provide a full transcript of the minutes from the meetings that document the refusal of planning BA/2014/0195/Ful, detailing ALL reasons why the planning was refused, and by whom. Also, the minutes of the relative and subsequent meetings, that approved the subsequent planning BA/2015/0277/FUL, documenting how, why and by whom, this planning was approved, ignoring many of the original recommendations made by Fergus Bootman, in the refusal of planning BA/2014/0195/Ful.

Thank you for your request for  documentation of the reasons for refusal
of the applications BA/2014/0195/FUL and BA/2015/0277/FUL.  Both of these
applications were dealt with under planning officer delegated powers, did
not go to the Planning Committee and therefore there would not be any
Committee minutes. All the details, the Delegated Decision reports and the
Decision Notices may be viewed from our website and the planning

Dear Essie Guds,
Good Morning -
and thank you for your timely response.

Could you please supply specifics, as to why the rejection of BA/2014/0195/FUL and the subsequent BA/2015/0277/FUL approval, was not subject to review by the Planning Committee, particularly when there were so many recommendations for refusal of the application.

If there are no minutes available detailing these decisions, please advise me where I can locate, or request from whom, the information I originally requested -
- ALL reasons why the planning BA/2014/0195/FUL was refused, and by whom.

- All reasons why the planning BA/2015/0277/FUL was approved, detailing how, why and by whom,
planning was approved, ignoring many of the original recommendations made by Fergus Bootman, in the refusal of planning BA/2014/0195/Ful.

In addition, could you please advise where I can locate details of when and by whom, a site visit was conducted prior to approval of planning BA/2015/0277/FUL.

Dear Mr Ling,

 

I have responded to your request on 22 November by providing you links to
the planning file on our website containing the information you are
requesting. In addition both the Director and Chief Executive have
responded to an official complaint from you concerning the same
applications. I therefore don’t see how I could be of any further help to
you.  

 

In regards to your additional request, the site was visited on 15/09/2015,
and on subsequent dates (after decision). The site visit on the 15th
September 2015 would have been by Alison McNab (née Cornish) as she was
the Case Officer for the application. She would have visited the site 1.
To affix the site notice, and 2. to view the physical context of the
application.

The information above is garnered from our photo database; Alison took
photos of the location of the site notice and the site itself. The photo
files have dates associated with them, which is how we know it was on that
date.

As you know, the files you provided the links to, do not contain the information I actually requested from you, the director, or the Chief executive -
1. How was the second planning application approved, by who, and specifically why, when it contained things that the original planning was rejected for - e.g. exceeding the footprint of the original / current property ?
2. How was a 'random' trench dug two days prior to the expiry of the planning permission, accepted as commencement of works, when:
a) There was no link from the trench that was dug, to what appears on the actual plan (either depth, location or size etc.)
b) The conditions of the approval, stated that no works could commence until ALL conditions had been met.
c) Most of the conditions were not met/signed off until July 2019 just prior to the actual demolition of the original property.
Also, can you please supply:
a) Any documentation, evidencing that the site notice was actually affixed.
b) The supporting documentation/records from the physical review of Alison McNab (née Cornish)15/09/2015
c) Copies of and description details of the photographs taken and filed at the time of Ms. McNabs site visit.

provided you with links where to find the information which is within
public domain.  With regard to your further questions:

 

a) Any documentation, evidencing that the site notice was actually
affixed.

b) The supporting documentation/records from the physical review of Alison
McNab (née Cornish)15/09/2015

c) Copies of and description details of the photographs taken and filed at
the time of Ms. McNab’s site visit.

 

I am attaching all the photos Alison McNab took on the site visit, which
includes photos of the site notice. Any documentation you are requesting
under (b) again will be on file which can be accessed from our website
through the link provided in our original response.

Thank you once again for your response, but as I pointed out previously, I cannot locate answers to the specific questions I have repeatedly asked, -

Dear Mr Ling,

 

In regards to your questions 1 and 2 in your email below, we addressed
those queries in our email dated 22 October 2019 under queries 1 and 5 (
please find email attached).

 

As the matter is now being dealt with by the Local Government and Social
Care Ombudsman, we need to await the outcome of their investigation. We
