A case held soon after the passing of the National Minimum Wage Act looked at the definition of ‘worker’ as defined by the Act. It indicates that tribunals may interpret the legislation widely.

This is Bain v Post Office Counters [1999]

Mrs Bains, a sub-postmistress, claimed that under the terms of the Act she was a worker, and therefore entitled to the Minimum Wage. Though Mrs Bains was not an employee – rather her contract was a contract for services – she argued that her contract did fall within the definition of ‘worker’ as defined by the Act. The Respondents argued that as her services were not 'personal' (as defined by Section 54(3)(b)) she was not a ‘worker’ and not entitled to the Minimum Wage. However, the tribunal disagreed with the Respondent, stating that many of Mrs Bain’s duties and responsibilities would be virtually impossible to fulfil without a fair degree of personal input. For example, her contract stipulated that she had a duty to ensure that transactions were carried out accurately, with reasonable steps to prevent fraud, that documentation was properly completed and timeously dispatched, and any losses incurred by her assistants were to be discharged by the applicant. She was also expected to undertake training sessions in putting the customer first. Her claim was found to have fitted into the definition of worker in accordance with section 54(3)(b) and she therefore won her case.

Dear FOIA,

Your first response stated you do posess the time it takes to process transactions.

Transaction A takes 1 minute

Transaction A can be completed 60 x in 1 hour

The rate of pay for Transaction A is # pence x 60 = £#.##

This figure is either above or below £6.19 the national minimum wage. How can you possibly claim this will take longer than 18 hours to work out the pay on four transactions you admit you possess transaction times for?

Your Mr Micheal Larkin at your recent NT roadshows has been telling sunpostmasters that the rates of pay for many of the transaction they process does not pay the national minimum wage can you please confirm which transactions he is referring to?

Finally my request never referred to if Post Office ltd paid the national minimum wage, your response suggests an admission that the rates of pay do not pay the national minimum wage but Post Office ltd are exempt from complying with this law. The annotations kindly provided shows case law that Post Office ltd is obliged to comply with national minimum wage legislation. Can you clarify Post Office ltd position on this matter

Dear FOIA,

Thank you for your belated response, however you have yet again failed to answer the question. You admit to possessing the time it takes to process these transactions so please supply this information. The fact that you are happy to not have to pay £6.31 per hour pro rata is a different matter. Subpostmasters clearly do not have to work the required opening hours as they can employ someone else to work for them but you response suggests Post Office ltd has a lax attitude to the business plans put forward by prospective purchasers of a Post Office and the viability of any plans proposed.

As for your response regarding Mr Larkin the financial services he suggests would these be the ones sold predominantly at the Crown network you are so eager to sell because of their loss making and are the telecom services the same ones that has caused you to issue apologies to the Post Office network due to poor levels of service?

I am writing to request an internal review of Post Office Limited's handling of my FOI request 'Transaction times'.

Despite another 1.34 billion of taxpayers money yet again given to Post Office ltd to deliver a viable Post Office network Post Office ltd has yet again failed to deliver. With Post Office ltd yet again offering a non viable business proposition i believe it is in the publics interest for Post Office ltd to disclose if the models on offer are financially viable or give a valid explanation as to why despite its promises subpostmasters are reluctent to agree to these new business models before another 640 million is wasted by Post Office ltd.
