tendering process for various bus routes. Please accept my apologies for
the delay in responding.

 

Your request has been considered in accordance with the requirements of
the Freedom of Information (FOI) Act and TfL’s information access policy. 
I can confirm TfL does hold the information you require. You asked for:

For Tranche 422 I can advise that the intended awards for this tranche
were announced on 31st January 2013. Please refer to the attached press
release for details. All awards are provisional until expiry of the
standstill period for objections on 25 February 2013.

 

If no objections are received, award letters will be issued to the winning
tenderers. Upon receipt of an acknowledgement letter confirming acceptance
of the contract for each route, details will be posted on the TfL website
of the winning tenderer, number of bids received, awarded price, lowest
price received, highest price received, cost per mile and any relevant
supplementary information. 

 

Therefore in accordance with the FOI Act, TfL is not obliged to supply the
this information as it is subject to a statutory exemption to the right of
access to information, under Section 22 of the Act - Information intended
for future publication.

 
This exemption is subject to a public interest test, which requires us to
assess whether the public interest in applying the exemption outweighs the
public interest in disclosure. In this instance, it is considered that the
public interest favours the publication of this information, in context
and according to the pre-determined schedule, rather than in response to
your request, to ensure the information is provided accurately and in an
accessible manner.     

 

No structural changes are proposed for routes 60, 166, 293, 404, 412, 466,
612 and 685. The tender specification for route 434 is attached showing
details of the proposed Sunday service.

The contract expiry dates for the additional routes listed are shown
below. Those marked with an asterisk are potentially extendable for two

Subject: Outcome of internal review

 

I am contacting you regarding the internal review of your request for
information concerning ‘Tranche 422’. This review has been carried out
following your email of 4 April 2013 regarding the late response to your
request for information under the Freedom of Information Act. Please
accept my sincere apologies for the delay in responding.

 

I believe you have now received a response to your request on 18 April
2013.

 

It is clear that, in failing to provide you with a valid response within
20 working days, TfL is in breach of section 10(1) of the FOI Act. I can
inform you that the main component of the initial delay occurred as a
result of establishing with the business area what information is already
publically available in relation to ‘Tranche 422’ and what information
will be published on our website in the near future, therefore resulting
in the application of section 21 and section 22 exemptions. On behalf of
TfL I apologise for the delay that you experienced and for any frustration
and inconvenience this may have caused.

 

In view of these failings, we do not consider that this necessarily
represents the end of the internal review process. We consider that it
would not be fair to you to deny you the opportunity for an internal
review of the quality of the response simply because you have already
exercised your right to a review in view of our failure to provide a
timely response. As noted above a response has been provided since you
made your original request for an internal review, so if you are not
satisfied with the quality of the response, you may still request a
further internal review.

 

However, if you are dissatisfied with the internal review actions to date
you can refer the matter to the independent authority responsible for
enforcing the Freedom of Information Act, at the following address:
