On 27/06/2020 you made the following request for information, which has
been dealt with in accordance with the provisions of the Freedom of
Information Act 2000.

We are applying Exemption 43 to your request.
The Authority has created bespoke training materials and documentation for
staff within its Fire & Rescue Service. The bespoke nature of the
documentation has been created exclusively by West Sussex Fire & Rescue
Service for internal staff training and not for public distribution. There
are many external commercial enterprises offering training services and it
is my view disclosure of the requested training material information would
enable those enterprises to profit from the bespoke work created by West
Sussex Fire & Rescue Service. There would be concerns that should West
Sussex Fire & Rescue Service training material be used or adapted by
others, there would be risks to the wider public community, even if
delivered from a specialist provider. I am satisfied that the risk of
prejudice is more than a remote possibility and that it is evident that
there is a real and significant risk.
In applying the exemption, I have had regard to the public interest and
accept that there is always a public interest in disclosure where it
supports openness and transparency of public authority’s and their
decision making. However, I am satisfied that the public interest in
maintaining the exemption outweighs the public interest in disclosure.
Whilst there may be public interest in knowing that staff within West
Sussex Fire & Rescue Service have received suitable training, there is no
wider public interest in seeing the bespoke documentation created for that
purpose. There is a clear risk to the commercial interests of the
Authority for the reasons detailed above. The information is not readily
available to the public, and clearly if the information were publicly
available there would be no need for the creation of bespoke
documentation. By refusing disclosure, we aim to protect the integrity and
credibility of the training material, as well as the quality with which it
is delivered. The material has been prepared for internal use, and there
would be concerns should the material be delivered by unauthorised,
inexperienced or untrained providers in a manner that did not meet
standards required, and this could be detrimental to public safety.
West Sussex Fire & Rescue Service recognise those who have received the
training will have some knowledge of the content but we do not consider
this to be equivalent to its full and unrestricted disclosure into the
public domain in response to a request made under the Freedom of
Information Act. West Sussex Fire & Rescue Service has considered whether
it would be possible to disclose a redacted version of the requested
training material rather than withhold it in its entirety. However, we
consider that redaction and a partial disclosure would not be practicable,
and the concerns above would remain.
