Training for Planning Application Committee members

Response to this request is long overdue. By law, under all circumstances, Merton Borough Council should have responded by now (details). You can complain by requesting an internal review.

Dear Merton Borough Council,

Please provide the date on which each member of the Planning Applications Committee present at its meeting on 10 December 2020 last received training as provided for in the “council arranged training on planning matters” cited in Part 5-F of Merton Council’s Constitution (Protocol on Planning Matters). It would be preferable to provide the names of each member and the associated date of their training but please provide anonymised information as a less preferable alternative.

Yours faithfully,

Tony Burton

Dear Mr Burton

Freedom of Information 2000 /Environmental Information Regulation request
2004 F14925

We have now considered your request for information as set out in your
email below.

This information is exempt under section 40(2) of the Freedom of
Information Act, 2000.  This is because it is personal data and disclosure
would contravene the Data Protection Act. This applies because individuals
and their families do not expect their personal details to be revealed to
the world at large, which disclosure under the FOIA has to be considered
as.

In accordance with the Freedom of Information Act 2000 this is a Refusal
Notice to provide the names and training details of individuals. This
decision follows similar decisions made by the ICO:

[1]Microsoft Word - Decision notice for the website (ico.org.uk)

[2]FOIA-EIR decision notice template (ico.org.uk)

You have the right of appeal against the decision, as set out below.

If you are dissatisfied with the handling of your request or wish to
appeal against the decision to exempt any part of your request, you should
request an Internal Review at [3][Merton Borough Council request email] or write in to Freedom
of Information team, Merton Council, Civic Centre, Morden, SM4 5DX.

If you escalate to the Information Commissioners Office (ICO) without
following the council’s internal review process, the ICO will refer you
back to the council to enable the correct process to be followed.

You can also appeal to the Information Commissioner at:

Dear Merton Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Merton Borough Council's handling of my FOI request 'Training for Planning Application Committee members'.

My request anticipated the concern that a response would result in the release of personal data. While I do not believe this is a valid ground for refusing my request I specifically addressed the option of providing anonymised data and this has not been provided as an alternative.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...

Yours faithfully,

Tony Burton

Dear Merton Borough Council,

For the avoidance of doubt this is to confirm that my request for an Internal Review of this request is not discharged by the results of the Internal Review of my earlier related request on training for Planning Application Committee members - see https://www.whatdotheyknow.com/request/c...

It would be helpful to know when you think the results of the Internal Review of this request will be available.

Yours faithfully,

Tony Burton
