Dear Greenwich Borough Council,

I would like to have any information you have on levels and
composition of traffic running through the West Greenwich
Conservation Area (incl Crooms Hill, Hyde Vale, Point Hill,
Maidenstone Hill, Royal Hill, Circus Street and the roads
connecting them).

I particularly wish to see surveys undertaken before 2007 and
surveys between 2007 -09.

Dear Greenwich Borough Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Greenwich Borough
Council's handling of my FOI request 'Traffic surveys in West
Greenwich before 2007 and between 2007-09'.

The reason given by Greenwich Council is that "the request relates
to material which is still in the course of completion, to
unfinished documents or to incomplete data”.

How can the results of surveys carried out between 2004-2007 and
2007-2009 be described in this way? By definition, the surveys
carried out in those earlier periods are not in the course of
completion, unfinished or incomplete as they date from up to 6
years ago.

In the council's response it was suggested that this information
only should be made available after a decision which is to be made
by the council in Spring 2011 has been made. I can only imagine
that this decision refers to the vote on the council's proposed
gyratory around Greenwich Town Centre. I fail to see what traffic
data from up to 6 years ago on entirely different streets has to do
with this decision.

Quote-marks It is bizarre that the Council have cited Environmental Regulations as a reason for withholding information when under the Freedom of Information Act "any person making a request for information to a public authority is entitled—

(a)to be informed in writing by the public authority whether it holds information of the description specified in the request, and

(b)if that is the case, to have that information communicated to him."

The Council should have treated the request as one made under the Freedom Of Information Act 2000, and provided the information sought.

Quote-marks Have you had a response to the internal review?

The reason given for withholding the information (unfinished data) seems unsustainable. Furthermore, the Council would ALSO have to show that release is CONTRARY to the public interest in order to be entitled to withhold its release....that would be very difficult for them to do in the circumstances.

Dear Greenwich Borough Council,

It is now the 10 February and there is no word on the results of
the internal review.

To assist you, I would like to point out the following:

1) You reject the request for information on the basis that "the
request relates to material which is still in the course of
completion, to unfinished documents or to incomplete data". This is
patently wrong. The surveys I request were completed between
2004-07 and 2007-09.

2) My request for information should be considered under the
Freedom of Information Act. It is not clear to me why you invoke
the EIR and even so, as noted above, your interpretation of it is
wrong.

3) The elected members would not in any way be impaired from their
decision-making by the release of the requested information. It is
absurd to suggest otherwise.

4) Public interest. If, as I believe, the data would show that
traffic entering the CA has increased since TfL improved the A2 to
the South of Greenwich, then would this not imply that the
solutions to some of the rat-running through the area lie within
the remit of TfL? It could have had an important impact on the West
Greenwich TCM consultation, which has now come and gone while you
have indulged in these dilatory tactics. To set up a public
consultation and then deliberately withhold information which is of
direct relevance to it is not in the public interest.

I require a prompt response.

Dear Janice Goldsmith,

Re Request RFI/02605

In your original reply of 22 December 2010, you stated that "the
council decision is [to] withhold this information until the Spring
of 2011."

It is now the Spring of 2011, and the elected members have made
their decision as regards the Pedestrianisation/Gyratory proposals,
to which I believe you were referring in your reply.

I therefore would like you to release the information to me, in
accordance with your response.

Dear Ms Todd

Thank you for your e-mail dated 15th April. We have since been informed
by the Information Commissioner's Office in a letter dated 21st March,
under reference number, FER0377160, that you have made an appeal, in
that you allege the information you requested has been unreasonably
refused by the Council. I have been advised by our legal team that you
should have received a copy of this letter also.

Our legal team is currently liasing with the ICO with a view to
resolving this matter informally. I have been advised that the ICO or
our legal team will be contacting you by the 13th May at the very latest
as to what decision has been made.

Dear Janice Goldsmith,

Thank you for the information which I have now finally received
from you. I notice that the earliest traffic data you have sent to
me dates from May 2008 and deals with traffic on the main roads
(Trafalgar and Romney Roads). All other data affecting minor roads
dates from Dec 2008 and Dec 2009.

Can you confirm to me that no traffic data at all was collated
concerning the West Greenwich Conservation Area between 2004 and
May 2008?
