Traffic Regulation Order (Loading Restrictions) - Meridian Road, Cleethorpes, North East Lincolnshire

Waiting for an internal review by North East Lincolnshire Council of their handling of this request.

Dear North East Lincolnshire Council,

On 23rd July 2013, Councillor Ray Oxby (Portfolio Holder for Environment and Housing) considered a report from Marc Cole (Strategic Director Environment, Economy and Housing) that recommended an introduction of loading restrictions at all times in Meridian Road, Cleethorpes. The report stated that the area could be left as is, however, this will mean that disabled blue badge holders are exempt from the restrictions and may park for up to 3 hours at a time. Upon consideration of the report, it was resolved that the loading restrictions be approved.

I understand that permanent Traffic Regulation Orders (TROs) are subject to The Local Authorities' Traffic Orders (Procedure) (England and Wales) Regulations 1996, which impose various legal requirements prior to making an order, including:

* publishing a notice of the proposals in a local newspaper;
* allowing potential objectors 21 days to make representations;
* taking other steps the authority may consider appropriate for ensuring adequate publicity is given to persons likely to be affected by any provision in the order, which may include roadside notices and delivery of letters to premises;
* consultation with the police, the Freight Transport Association and the Road Haulage Association; and
* holding a public inquiry if the TRO would prohibit loading or unloading of vehicles (i) at all times, (ii) before 07.00 hours, (iii) between 10.00 and 16.00; or (iv) after 19.00, or if the passage of public service vehicles would be restricted.

I would be grateful if the Council could furnish me with following information in respect of the approved TRO pertaining to the loading restrictions in Meridian Road:

* a copy of the newspaper notice containing the proposal;
* what appropriate steps the Council took to ensure adequate publicity of the proposal;
* the consultation responses from the police, the Freight Transport Association and the Road Haulage Association; and
* a copy all documents, including background papers, pertaining to the public inquiry and its conclusion into the proposal.

Lincolnshire Council's handling of your information request 6513_1314,
concerning the imposed loading restrictions in Meridian Road.

I have reviewed the response provided to you and the handling of your
request in accordance with the Freedom of Information Act and find that
your request relates to information surrounding the TRO imposing loading
restrictions in Meridian Road and not the TRO imposing waiting
restrictions in the same road. I would like to confirm that the incorrect
notice has been provided to you in our initial response. The notice in
relation to loading restrictions has now been added. Please be assured
that all of the other information previously provided was in in relation
to loading restrictions in Meridian Road.
