Traffic Management Order Upper Green East

Please provide a copy of the Traffic Order which governs the Bus Lane located on Upper Green East, Mitcham.

Please also provide dates that the orders were made public in the London Gazette and the notice sent to the chief of police.

Notice of the making of the order16.—(1) When an order has been
made, the order making authority

shall–(a)forthwith give notice in writing of the making of the
order to the chief officer of police of any police area in which
any road or other place to which the order relates is
situated;(b)where the order making authority is not the fire
authority, forthwith give notice in writing of the making of the
order to the fire authority for the area in which any road or other
place to which the order relates is situated;(c)except in the case
specified in paragraph (2) notify in writing each person who has
duly objected to the order in accordance with regulation 7 or 29
and has not withdrawn his objection, of the order making
authority’s decision in relation to the objection and, where the
objection has not been, or not wholly been, acceded to, of the
authority’s reasons for their decision;(d)within 14 days of the
making of the order publish in a local newspaper circulating in the
area in which any road or other place to which the order relates is
situated a notice of the making of the order containing the
particulars specified in Part IV of Schedule 1;(e)within the same
period publish in the London Gazette a notice of the making of the
order containing the particulars specified in Part V of Schedule
1;(f)comply with the relevant requirements of Schedule 3 as to the
availability of documents for inspection.(2) The case referred to
in paragraph (1)(c) above is the case where the order making
authority have, before making the order, notified in writing the
person in question of–(a)their decision in relation to his
objection, and(b)where the objection has not been, or not wholly
been, acceded to, of the reasons for their decision.

Dear Merton Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Merton Borough Council's handling of my FOI request 'Traffic Management Order Upper Green East'.

Although details of the traffic order have been supplied the order is not legal until the change or order has been received by the Police. Also any changes MUST be notified in the local gazette.

I have requested these two further documents to be supoplied to show the legality of the bus lane and these have not been supplied as requested or in the time frame allowed by the information commisioner. I would like copies of these two documents sent to me as requested and hereby give you a further 7 days to respond befoire I initiate a complaint to the information comissioners office.

If you are unable to supply these document I will pass a claim to my solicitor for an "illegal fine" that I have settled whilst holding my right to appeal, and for all costs involved/incurred.

My request was for the original order made on the bus lane. The bus lane was extended a further 50 meters which is what your reply is relating to. This doesn't cover the original traffic management order of the bus lane.

I would like copies of the ORIGINAL order and not the extension of 50 meters, and also the adverts and a copy of the letter to the ORIGINAL order when the bus lane was put in.

The correct Traffic Management Order is attached, please accept my apology
for sending you the incorrect order previously. 

Regrettably, we are unable to provide you with copies of the adverts for
this Order.  This is because these are not held, as they date back to 2001
and we only retain paperwork for 6 years.  We are also unable to provide
you with a copy of the letter sent to the police for this Order.  This is
because this is not held, as these are standard format letters and copies
are not retained.
