I am writing to request an internal review of Leicestershire County Council's handling of my FOI request 'Traffic data Collection - Hinckley'.

Clearly LCC had knowledge of this survey and granted permission for the equipment to be set up. It is therefore very hard to believe that it does not know who collected the data and for what purpose.
Also the notice posted with the equipment said no personal data was being collected, whereas vehicle number plates can be used to identify owners.

Outcome of Internal Review – FOI 000271

Thank you for your internal review request dated 22nd November regarding a
Freedom of Information request in which you asked for:

‘A camera has been set up in Hollycroft, Hinckley just outside the park
and directed North-West towards Stoke Road away from the town centre.

 4.   Does it run continuously?

The purpose of an internal review is to assess how your Freedom of
Information request was handled in the first instance and to determine
whether the original decision given to you was correct.  This is an
independent review and I can confirm that I was not involved in the
original decision.

Your original request was submitted on 13th November 2018 and the response
was issued on 22nd November 2018.  You were unhappy with the response
provided to question number 5 as the response stated that the department
were unaware of the reason why the data was being collected by the
external company. 

In the course of my review, I have found that the response provided to you
was technically incorrect.  The first part of the response is correct in
that the data was being collected by an external company, however, the
purpose should have said ‘Traffic Survey’.

The department is unaware of the purpose of the survey, nor are we
required to as defined by the Traffic Management Permit Scheme
Regulations.  Quite often external surveys of this scale are for planning
applications, however, we don’t know that for certain.  In most cases, the
survey company won’t know the reason for the data being collected either
as quite often it’s for a third party.

With reference to personal data being captured, the survey company would
need to be involved to detail their procedures, although the data is
generally anonymised.

I would like clarification please on the previous Internal Review.

Are you saying that when granting this permission you have no obligation to ensure that the company making the request will comply with privacy legislation? i.e. they can collect whatever data they wish under the guise of a traffic survey and do whatever they like with it.
