Thank you for your request for information relating to Trading Standards unsafe toys. Your request was received on 08 March 2021, and we are dealing with it under the terms of the Freedom of Information Act 2000.

Information requests during Coronavirus (COVID-19) outbreak

We will try to respond to information requests and where possible within time frames (within 20 working days beginning the day following receipt of your request). However, the Council needs to prioritise its staff and resources on the delivery of key services, this means that some responses may be delayed. The Information Commissioner recognises this, and has given guidance on the website

For your information, the Act defines a number of exemptions which may prevent release of the information you have requested. There will be an assessment and if any of the exemption categories apply then the information will not be released. You will be informed if this is the case, including your rights of appeal.

You should receive a response to your Freedom of Information Request by 8th April, 2021.

In some circumstances a fee may be payable to cover the cost of copying and postage and if that is the case we will let you know before we proceed with your request.

Further to your request for information under the Freedom of Information Act, please see below.

1. what resources and tools does the council have to regulate unsafe toys from online marketplaces?

We receive information regarding unsafe toys from Complaints received into the Trading Standards Service and have access to the national consumer complaints database. We receive referrals from the ports, other Trading Standards Authorities and from the Office for Product Safety and Standards (OPSS) . We have access to a product safety data base and we receive advice and weekly notifications from the OPSS.
We have access to testing laboratories is necessary.
Most on line platforms have a Primary Authority relationship with their local Trading Standards, who we can contact to get products removed and we can contact some platforms directly.
We have legislative powers to deal with toy safety issues that cover on line sales.

2. How much toy safety testing has the trading standards office done from 2018-2020?

We have not sent any toy related products for testing during this period.

We trust this now resolves your enquiry. Where we have not been able to provide details we expect that this information is not held by Nottinghamshire county Council at this time.
