Dear Advertising Standards Authority,

I have noticed whilst reading some of the cases what your organisation have investigated that a percentage of them are referred to Trading Standards.

Could you please let me know what the criteria or threshold is for when an advertiser is referred to Trading standards.

For example has the advertiser been involved in not just misleading advertising but does it have to be seen or proved that they are involved in deceptive or criminal actions as well as misleading advertising for them to be referred.

similar ads in future.

Dear Michelle,

Thank you for your e-mail. The Advertising Standards Authority (ASA) is not subject to the Freedom of Information Act 2000, as it is not a body listed by the Act as being a public authority. The ASA is independent from Government and receives no funding from the taxpayer. However, we will try to provide information requested when possible.

Trading Standards are our legal backstop. When an advertiser will not comply with our rules and other sanctions have failed, we can then refer them to Trading Standards. We have this leaflet available to download on our website which explains our work with them:
