We confirm that there are no contributions within Hertsmere Borough
Council's remit of the s106 agreement for TP/2003/0987 that remain

I am writing in response to your Freedom of Information request for
further information received on 26 August 2020.

 

Your request has now been considered under the terms of the Freedom of
Information Act and/or Environmental Information Regulations and we are
able to respond as follows:

 

 

Your Request:

Further to your response can you please provide evidence of expenditure?

 

 

Our Response:

Further to your request we confirm that we do not  have any detail of the
evidence of expenditure for projects related to S106 collected for
planning application 2003/0987. It is likely that in accordance with
normal council procedures the information has been destroyed. Financial
information is only normally retained for 7 years. After this time it is
no longer legally required to be kept. We can confirm the S106planning
obligation headings as follows:-

 

2.2 Contribution for Improvements to Aberford Park

Not to Occupy or cause or permit Occupation of more than 74 Units until
they have paid the sum of £111,150 to the Council for improvements to
Aberford Park, Borehamwood, Hertfordshire;

 

2.3 Contribution for Controlled Parking Zones

That it will upon receipt of a written request for payment from the
Council, within five (5) years of the Practical Completion of all the
Units, pay to the Council a maximum sum of £5,000 for the implementation
of controlled parking zones at the Site; and

 

2.4 Contribution for Film Museum

Not to Occupy or cause or permit Occupation of more than 74 Units until
they have paid the sum of £50,000 to the Council for a film museum or
similar heritage project in Borehamwood, Hertfordshire.

 

As far as we are aware all of these allocations were spent and the related
infrastructure/improvements provided.
