Dear Burnley Borough Council,

On the 18th November 2019 BBC issued a notice for quotes for Towneley Hall Art Gallery and Museum including, Quinquennial Report, Preparation of a Maintenance Plan for priority works, Statement of Heritage Significance & Hertage Impact Assessment, Schedule of Significance, Preparation of a valuation of the building, a Conservation Management plan, design, specification and schedules for tender and the appointment of a main contractor followed by its Contract supervision. This work also included a priced condition survey, options appraisal and feasibility study.

1) Can you please provide a copy of the document, table or matrix which demonstrates how the tenderers were assessed and subsequently scored including the financial value of their tenders i.e. Stage 1 (fixed fee), Stage 2 (fee percentage) and Future Repair (fee percentage).

2) Please provide a copy of the tender report which makes recommendation for the appointment of the preferred tenderer.

3) Please provide the name of the successful tenderer.

be recommended as preferred tenderer 
You may, if dissatisfied with the treatment of your request, ask the
council to conduct a review of its decision under the council's complaints
procedure. The review will be carried out by someone who has not been
involved in dealing with your request for information. Please e-mail or

If, following the review, you remain dissatisfied with the council's

As it so happens, this information has been provided before - without question - by other authorities when responding to similar requests. If you are unwilling to provide this information, can you please tell me on what basis you have decided to withhold this information.

Alternatively, can please update the document to include the names of all tendering companies.

Following advice received I wish to inform you that:

The Council holds this information but has a applied an exemption under
Section 43(2) of the Freedom of Information Act – Commercial Interests.

It is a current tender process and release of the information would likely
harm the Council in addition to the commercial interests of the companies.
The Council releases key information on the tender in relation to the
contract but does not release the names of tendering parties. The name of
the successful tender will be published in the transparency data relating
to contracts on the councils website.

The Council has considered a public interest test in response to this and
recognises that there is a public interest in releasing key tender
information which it routinely does to both tender parties and as part of
transparency data, at an appropriate time. However the Council considers
that the public interest is currently outweighed by the harm to the
commercial interests that could arise from this release.
