Tottenham Town Hall redevelopment and Section 106

We're waiting for J Purcell to read a recent response and update the status.

Dear Haringey Borough Council,

I would like answers to the following questions please:

1, Who owns Tottenham Town Hall?

2, Is there a lease on Tottenham Town Hall to the present occupiers, Lea Valley Estates?

3, If there is a lease, what is the duration?

4, What are the conditions of the lease?

5, Is there a section 106 agreement relating to Tottenham Town Hall and the land at the rear of the Town Hall, being developed for housing?

6, What are the precise requirements of that section 106 agreement?

7, What requirements are there for community use and access within either the lease, or the section 106 agreement relating to Tottenham Town Hall and/or housing development at the rear of the Town Hall?

8, Is a church or other place of worship allowed to operate on the site, including within The Moselle Room, as part of the conditions of either the lease or Section 106?

9, Was planning permission for a place of worship, categorized under the D class, sought and obtained for Tottenham Town Hall, also known as The Legacy Centre, with there also being B1 (office) use?

10, Is Lea Valley Estates the same organisation that operates as the developer of Hale Village at Tottenham Hale?

11, Is there a section 106 agreement for the development at Hale Village, and if so, what are the exact requirements of that agreement, including the original agreement and any subsequent changes or amendments?

12, How much money was originally required as Section 106 payment for the Hale Village development when planning permission was first sought and granted?

13, How much of the original sum of Section 106 money required when planning was sought for Hale Village has been paid to date?

14, How much, if any, of the original sum of Section 106 money required, has been discounted due to unfavourable market conditions?

15, What due diligence was undertaken to ascertain the financial position of the developers of Hale Village required to pay money, as part of the original Section 106 agreement, if any discount on the total sum owed was granted?

16, If any such reduction for Hale Village was granted, when did this happen and who authorised the reduction?

17, Are the minutes of meetings where the decision(s) to develop Tottenham Town Hall and the former council depot land at the rear available, including references to due diligence and open tendering process undertaken to identify development partners for the site(s)?

18, When was the decision made, by Haringey Council, to enter into a partnership arrangement with Lea Valley Estates, Newlon and others to develop Tottenham Town Hall and the former council depot at the rear?

19, Who at Haringey Council made this decision and what process was followed for such authorisation?

20, What public advertisement was undertaken to identify development partners for Tottenham Town Hall and the rear council depot?

21, How much revenue is earned by Lea Valley estates from room rental, hire and other leasing income and fees from Tottenham Town Hall? (Known as The Legacy Centre)

22, What monies are owed by Lea Valley Estates and Newlon to Haringey Council for any purpose whatsoever, including Section 106?

REQUEST FOR INTERNAL REVIEW OF LBH/1190212

I am writing in response to the Freedom of Information request that I submitted to Haringey Council on 16th October 2012. The formal acknowledgment of my request was dated 19th October 2012 and this confirmed that I would receive a response by a deadline of 13th November 2012.

I did receive a reply on 13th November 2012, although the response only gave partial answers to questions 8, 9, 17, 18 and no answer whatsoever to questions 1-7, 10-16 and 19-22. This is unacceptable, as is the fact that Haringey took the full 20 working days and yet not only failed to answer 18 of my 22 questions in any way whatsoever but also gave no reason as to why these 18 questions were not answered.

On the basis of the failure to:
1, Provide me with a full response to all of my questions OR;
2, Request more time to provide answers OR;
3, Formally refuse to provide the information AND
give specific reasons for doing so,

Haringey Council has not met its legal obligations and is in breach of the law. I consider this to be serious.

To further compound the unacceptable response, I have been referred to as 'Purcell' and 'Mr Purcell' when my name was clearly identified in my original request as Jessica Purcell. This level of incompetence and poor administrative standards is appalling. As such, I would like to formally request an Internal Review, as per the advice of the Information Commissioner's Office. I would like this review to consider not only the failure to properly reply to my 22 questions but also the poor standard of the response that was sent.

If the Internal Review, which should take an absolute maximum of 20 working days to be conducted, and up to 40 days only if extenuating reasons can be provided as to why this extra amount of time were to be needed, does not adequately deal with the 22 questions that I originally submitted, I will:

1, Lodge a formal complaint to the Information Commissioner's
Office under s50 of the Freedom of Information Act 2000
2, Consider copying my complaint to the ISO to the local press
