Total number of 4th year pupils who 'legally' leave School before completing formal Education

We're waiting for Louise Woodland to read a recent response and update the status.

Louise Woodland

Dear Highland Council,

This is a Freedom of Information request regarding the total number of 4th year pupils who 'legally' leave School before completing formal Education.

For each year from academic year 2014-2015 to 2018-2019, I would like to know the total number of fourth year pupils who were due to complete National 3, 4 or 5 qualifications but who legally left school before finishing fourth year. I am only interested in those who were in the process of undertaking these qualifications and did not complete them, not those who would not have been presented for any of these even if they had completed fourth year.

To clarify, by “legally” I mean those children who were 16 years of age by the end of February in fourth year (in accordance with the Education (Scotland) Act 1980, section 33, sub-section 2a) who were entitled to leave due to having had their entry to primary school legally deferred (they started school at age five not four -in accordance with section 32, sub-section 3 of the Education (Scotland) Act 1980).

I am trying to establish how many children who would have been presented for National 3,4 or 5 qualifications if they had continued S4, left before completing these.

Yours faithfully,

Mrs L Woodland

Freedom of Information, Highland Council

Dear Ms Woodland,

Request for Information under the Freedom of Information (Scotland) Act
(FOISA)

Further to your request for information on 12 June 2019 and subsequent
request for a review on 28 August given the council did not respond to
your request within the legislative timeframe.  I am aware that this
response is long overdue after looking into this it appears there was
administrative error which resulted in your response being recorded as
completed when it was not, for which I apologise.

Below is the response that we received from our Education department.

Year Number Enrolled Number who left before 20 April  of each year in
S4
2015/16 2,496 16
2016/17 2,417 17
2017/18 2,344 14
2018/19 2,361 13

However of the above figures, we do not know whether they were due to
complete National 3, 4 or 5 qualifications, as this information is not
available to us.  It is also possible out of the above figures some pupils
went on to another location, e.g. another school outside Highland,
college, etc., and sat their exams there.  Therefore in respect of this
part of your request, we are unable to provide you with this information,
this is in line with Section 17 of the FOISA.

If you remain dissatisfied with any aspects of my response regarding the
provision of recorded information, you have the right to request that the
Scottish Information Commissioner takes up an appeal on your behalf.  The
contact details are:

Scottish Information Commissioner,

Kinburn Castle,

Doubledykes Road,

St Andrews, Fife

KY16 9DS

Telephone: 01334 464610

Fax: 01334 464611

e-mail: [1][email address]

Your request should contain details of the aspects of the Council’s
response with which you are dissatisfied and should be made within 6
months of receipt of this review response.  If you are subsequently
dissatisfied with the outcome of your appeal to the Commissioner you then
have the right of appeal to the Court of Session regarding a point of law.

Yours sincerely,
