Dear Ms Symington,

I would like to make a formal request under the Freedom of Information Act 2000. I am also making this Request under the Environmental Impact Regulations 2004 which require disclosure on the part of Local Authorities.

1) The Davis Langdon report to Cabinet of 17th July 2013 states the following:
“3.4.3 The current gross internal floor area totals some 7,722 m2, with the former Hotel providing 5,784 m2 and the Office Extensions 1,938m2." http://eastdevon.gov.uk/media/1183866/ca...

This is also referred to in an earlier FOI Request, where you state:
“The floor space area was calculated by an independent consultant and cross-checked with the Display Energy Certificate (DEC).” https://www.whatdotheyknow.com/request/c...

2) The Valuation Office website states the following:
“Address of property: KNOWLE THE, STATION ROAD, SIDMOUTH, DEVON, EX10 8HL
“Total area: 4871.85 [sqm]”

I would be grateful if you could provide an explanation for the apparent discrepancy and provide me with evidence as to how the actual floor space at Knowle is calculated.

You asked:
I would be grateful if you could provide an explanation for the apparent discrepancy and provide me with evidence as to how the actual floor space at Knowle is calculated.

This request is in relation to an apparent discrepancy between a figure published by the council and a figure published by the Valuation Office.

As previously advised in our response to you dated 13th February 2014, the floor space area at the Knowle was calculated by an independent consultant and cross-checked with the Display Energy Certificate for the building. We do not hold precise figures for the floor space area other than those provided to us by a third party, nor do we hold background calculations to these figures.

With respect to your question about any apparent discrepancy between information we hold and information held by a third party, we do not hold any information in response to this element of your request.

Thank you for your email of 18th July. Your email requests an internal
review of our response to a previous information request but does not
specify which aspect(s) of our response you were dissatisfied with.
Rather, your email seems to be asking for clarification and for further
information. We are happy to provide this additional information below:

 

•             The independent consultant who provided the floor space
calculation was Thomas Lister

•             It would not be practical for us to search through every
council document to find references to floor area, over an unlimited time
period, and we consider this element of your request to be unreasonable.
If you are able to narrow down precisely the detail you require, we will
do our best to help you.

•             The Display Energy Certificate is attached and is also on
public display at the council’s offices

Thank you for your reply of 3rd August.

With regard to ‘the current gross internal floor area’ as used in the relocation project, thank you in particular for providing me with the reference to the consultant who provided the calculation.

However, I find it mystifying that the District Council had simply accepted figures ‘provided to us by a third party’ without asking how those figures had been arrived at – especially for such a crucial project.

> I would like you, therefore, to provide me with any communication between council officers and the consultant Thomas Lister on the subject of ‘the current gross internal floor area’; and

> I would also like you to ask the consultant Thomas Lister directly http://thomaslister.com/ to provide me with the floor-space calculations. Thank you.

With regard to the figure published by the Valuation Office, this has a direct bearing on the interests of the District Council, as it is this figure which forms the basis of the business rates the council pays: http://www.2010.voa.gov.uk/rli/static/He...

Similarly, I find it equally mystifying that the District Council will simply accept the valuation of its property without asking how these figures had been arrived at – especially for such a large building.

> I would like you, therefore, to specify how these figures were arrived at – either as a series of calculations made by your own officers which were provided to the VOA, or following inspection by the VOA itself who will have provided you with the resulting paperwork. I would like you to provide me with any such documentation. Thank you.

In answer to your specific requests for information, I respond below as
follows:

 

I would like you to provide me with any communication between council
officers and Thomas Lister on the subject of the gross internal floor area

I confirm that no information is held. Officers did not make enquiries
regarding how this figure was calculated.

 

With regard to the figure published by the Valuation Office....I would
like you to specify how these figures were arrived at ...and any such
documentation.

I confirm that no information is held. We do not hold copies of any
correspondence with the Valuation office regarding their calculation of
this figure. In the consideration of your internal review, we have
downloaded the attached document which is freely available from the VOA
website and which you may already have a copy of. This document has been
downloaded since your request in an effort to be helpful, it was not held
at the time of your request and is publicly accessible by other means.

 

Finally, we are under no obligation to require our contractor or to ask
the VOA to contact you directly to aid your understanding of information
they have produced. This enquiry does not form part of your request for
information.
