Dear Andrew,

Thanks for your response.

Your consideration since 7th January has now taken you over the 20 working day limit.

In the spirit of moving things along and reducing the scope of the request, please exclude all COT3 Agreements and all compromise agreements
drawn up in the following circumstances:

1. Purely redundancy situations
2. Purely PILON (pay in lieu of notice) situations
3. Equal pay claims
4. TUPE situations

Further to this, please reduce the time period to the years between
2005 and 2010 i.e. the last six years.

I am researching this particular area and aim to view trends and
movements both regionally and nationally. It would benefit myself
and the authority if the figures reached were as accurate as
possible.

When responding, please give figures in calendar year format e.g.
2005 - 1; 2006 - 3; 2007 - 2; etc.

Yours sincerely,

Paul Cardin

Dear Salford City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Salford City Council's handling of my FOI request 'Total Annual Figures for Compromise Agreements, etc.'.

Your response is now long overdue. I have also reduced the scope of the request in good faith.

This request has now been responded to positively and in full by 251 English Councils since 1st January 2011. I'd appreciate it very much if while conducting this internal review, you took into account all the
questions and information I have supplied to date.

A full history of my FOI request and all correspondence is available on the Internet at this address:

Yours faithfully,

Paul Cardin

Webb, Teresa, Salford City Council

Dear Mr Cardin,

I am writing in response to your email of 5 March in which you ask for an
internal review of the council's handling of your Freedom of Information
request of 7 January. You point out that the response is long overdue and
that you reduced the scope of the request in good faith.

Having reviewed all communications in respect of your request I
acknowledge that the council has not responded within the statutory 20
working days and, therefore, has failed to comply with section 10 (1) of
the Act in this instance. I can only apologise, on behalf of the council,
for the delay in our handling of your request and any inconvenience this
may have caused.

I can confirm that the council does hold the information you are seeking.

Dear Webb, Teresa,

"Shortly".

It is now May and I've heard nothing whatsoever. The original request was lodged in January 2011.

I'd appreciate an update very much,

Yours sincerely,

Paul Cardin

Van Damms, Andrew, Salford City Council

Dear Mr Cardin,

Thank you for your email of 3 May 2011 regarding your Freedom of
Information request of 7 January 2011. I apologise for the time it has
taken to respond following Ms Webb's email to you of 29 March 2011.

You initially requested the following information:

'Please supply annual totals for the following:

As far as records go back, the annual figures for the total of current
employees / ex-employees (including teaching staff) of the Council who
have signed compromise agreements directly related to the resolving of
dispute(s) / grievance(s) / internal and external investigation(s) /
whistleblowing incident(s).

In addition to this, annual figures for the number of current employees /
ex-employees (including teaching staff) who have agreed, following the
matter being raised and made conditional as part of a compromise agreement
drawn up by the body acting as the Council's legal team, to sign and forgo
their right to approach the council in the future with Freedom of
Information and/or DPA Subject Access requests under the relevant Acts.'

You subsequently narrowed the scope of your request by restricting the
period it covered to the last 6 years and excluding COT 3 agreements and
all agreements drawn up in the following circumstances:

1. Purely redundancy situations
2. Purely PILON situations
3. Equal pay claims
4. TUPE situations

In terms of your revised request, the council can provide you with the
following information:

+--------------------------------------------+
| Year | No of compromise agreements |
| | (excluding above categories) |
|------+-------------------------------------|
| 2005 | 0 |
|------+-------------------------------------|
| 2006 | 8 |
|------+-------------------------------------|
| 2007 | 2 |
|------+-------------------------------------|
| 2008 | 10 |
|------+-------------------------------------|
| 2009 | 12 |
|------+-------------------------------------|
| 2010 | 8 |
+--------------------------------------------+

The council has not in any instances inserted a clause in a compromise
agreement restricting an employee or former employee from exercising their
right of access to information under either the Freedom of Information Act
2000 or Data Protection Act 1998.

The council considers it has fulfilled your Freedom of Information
request. However, if you are dissatisfied with the way your request has
been handled, or wish to appeal this decision, you may wish to contact
David Sackfield, Head of Business Support and Information Management,
Customer and Support Services Directorate; email:
[email address].
Details of how to lodge an appeal can be found at [1]www.salford.gov.uk.

If you are still dissatisfied following any internal appeal, you may wish
to contact the Information Commissioner's Office, Wycliffe House, Water
