This relate to events of today, 15 May 19 or thereabouts.

According to this video:

at 1:05 the video says that you told MEP candidate, Mr Tommy Robinson/his driver, "stop you are not allowed any further". Police then told the driver that the 'council' had instructed them not to let vehicle anywhere near the city centre of Carlisle.

Request: -
I would all all information relating to the stop.
This includes but is not limited to, the lawful basis for stop and correspondence with the relevant police force(s) and Home Office etc.
What was the cost of the OVERALL operation for the the day.

This is not personal data, nor is it covered by section 31 FOIA exemption, as no crime was committed.

Please find attached the response to your Freedom of Information request.

In addition, you will note that some information has been blacked out. This is due to the information consisting of personal information such as names pertaining to staff and third parties. The Council considers it necessary to withhold the information as we consider that the exemption under section 40(2) applies to it. Section 40(2) of the Freedom of Information Act 2000 provides that:

“(2) Any information to which a request for information relates is also exempt information if—

(a) it constitutes personal data which does not fall within subsection (1), and

(b) the first, second or third condition below is satisfied.

(3)(a) The first condition is…that the disclosure of the information to a member of the public otherwise than under this Act would contravene —

(i) any of the data protection principles, or…”

In this case we believe that disclosure of the information would result in a breach of Article 5(1)(a) of the General Data Protection Regulation where the information must be processed lawfully and fairly; there being no suitable lawful basis for processing under Article 6 to allow for disclosure. We furthermore do not believe it would be fair to disclose the information.

As a result, we are refusing to provide the blacked out information under section 40(2) read in conjunction with section 40(3)(a)(i) of the Freedom of Information Act 2000.

This exemption is absolute and therefore not subject to the public interest test.

Dear Mr Williams,

The redactions are in relation to individuals who posted/ tweeted/ liked or otherwise the post. In relation to the Milkshake comment, Macdonald's was tagged with the comment, 'How are milkshake...'. We however are unable to disclose the identity of the post writer as individuals have the right to delete posts etc. at a later date, and it would not be appropriate for the Council to release their identities and/ or usernames because of this, even though this information may still be publicly available.

I hope you are satisfied with the response to your follow up query however, if you are dissatisfied with the Council's decision and wish to have this reviewed, you can do so by advising us as per the details within the original response.

Dear Mr Williams,

 

In accordance with Section 1(1) of the Freedom of Information Act 2000, I
can advise that the Council does not hold any recorded information on
whether the contributer was a staff member or not. I can advise that the
Council has not received any allegations to suggest it was a staff member
and has no suspicions that it was.
