TM44 Air Conditoning

Response to this request is long overdue. By law, under all circumstances, East Sussex County Council should have responded by now (details). You can complain by requesting an internal review.

Dear East Sussex County Council,

You will be aware that all buildings in the UK with more than 12kw of combined air conditioning should have what is called a TM44 Air Conditioning Assessment lodged on the Government Landmark database every 5 years. Your buildings appear to have not got these Certificates and may be unlawful.

When do you intend to get these TM44 surveys undertaken?

Climate change is important, why have you not complied with this Legislation?

Who, specifically, is responsible for this issue; please supply all contact details?

We are compiling a register of non-compliant Organisations, please be aware that your responses will be tracked for use and forwarded to Government Departments.

Thank you for your request for information about the above. Your request
was received on 2/12/2015 and I am dealing with it under the terms of the
Environmental Information Regulations 2004.

We always aim to respond as quickly as possible, and in this case will do
so no later than 2/1/2016, which is the 20 working day deadline. The
deadline is counted from the first working day we receive it, not the date
a letter is written / posted or an email sent.

RESPONSE

 

1.    Most East Sussex County Council (ESCC) buildings do not have air
conditioning with a combined capacity in excess of the 12kw threshold that
requires a TM44 Air Conditioning Assessment. Where they do, the
assessments have been carried out.

    

2.    For ESCC sites that do exceed the 12kw threshold for TM44 Air
Conditioning Assessments the required assessments have been undertaken at
the time that the legislation came in. These will require renewal in 2016
which we have procured a contractor to undertake.

    

3.    Not applicable – see previous answers.

 

4.    TM44 Air Conditioning Assessments for the ESCC non school estate are
funded and managed from the maintenance budget managed by Peter Bowley,
Maintenance Manager – [1][email address].

 

TM44 Air Conditioning Assessments for schools are their responsibility to
fund and organise from their devolved budget. ESCC offers schools approved
contractors to undertaken but they do not have to use these.
