TM44 Air Conditioning

Response to this request is long overdue. By law, under all circumstances, King's College, Cambridge should have responded by now (details). You can complain by requesting an internal review.

Dear King’s College, Cambridge,

You will be aware that all buildings in the UK with more than 12kw of combined air conditioning should have what is called a TM44 Air Conditioning Assessment lodged on the Government Landmark database every 5 years. Your buildings appear to have not got these Certificates and may be unlawful.

When do you intend to get these TM44 surveys undertaken?

Climate change is important, why have you not complied with this Legislation?

Who, specifically, is responsible for this issue; please supply all contact details?

We are compiling a register of non-compliant Organisations, please be aware that your responses will be tracked for use and forwarded to Government Departments.

This is in reply to your enquiry received by the College on 14 December 2015 and made under the Freedom of Information Act 2000 (FOIA).

In fact your request is for information about the environment and so the Environmental Information Regulations 2004 (EIR) are the appropriate legislation within which to respond to your request. The Information Commissioner's Office advises, in the section entitled 'How do the Environmental Information Regulations relate to the Freedom of Information Act?' on https://ico.org.uk/for-organisations/gui..., that we deal with requests under the appropriate legislation and so we are responding to your request under the EIR.

Attached please find our schedule of charges made under the EIR. If you agree to these charges being levied and wish to proceed with the request please let me know. It is possible that in the course of locating the information we will find that none of our air conditioners are over 12 kW and you will have a nil return for those parts of your request. You will still be charged for the time spent conducting the investigation.

If you have further questions please ask me in the first instance. If you are still not satisfied with the way that the College has dealt with your request, please address your complaint to the Bursar, King's College, Cambridge, CB2 1ST or [email address].

If the College is unable to resolve your complaint to your satisfaction, the EIR section 18 gives you the same rights as you have under FOIA section 50, to apply to the Information Commissioner 'for a decision whether, in any specified respect a request for information made by the complainant [i.e. yourself] to a public authority [i.e. the College] has been dealt with in accordance with the requirements of' the EIR.
