Further to your e-mail below, requesting information under the Freedom of
Information Act 2000, I am now in a position to respond to your questions
as follows:

 

You asked:

 

Could I please request the food hygiene report for Tiffins in Cwmbran that
was conducted in December 2018.

 

 

Although the premises now has a 4 food hygiene rating, investigations are
ongoing around the reasons for the 0 food hygiene rating which was issued
in December 2018.  Therefore, the information requested is exempt under
Section 30 (1) (b) of the Freedom of Information Act (2000), which states
:-

 

30 –(1) Information held by a public authority is exempt information if it
has at any time been held by the authority for the purpose of –

 

(a)        any investigation which the public authority has a duty to
conduct with a view to it being ascertained - (i) whether a person should
be charged with an       offence, or (ii)   whether a person charged with
an offence is guilty of it,

 

(b)        any investigation which is conducted by the authority and in
the circumstances may lead to a decision by the authority to institute
criminal proceedings           which the authority has power to conduct,
or

 

(c)        any criminal proceedings which the authority has power to
conduct.

 

The authority considers that the exemption contained within section 30(1)
of the FOIA is engaged subject to the public interest test, which means
that the Local Authority has to undertake a balancing exercise and
consider the factors for and against disclosure which we have considered
below;

 

The factors in favour of disclosure would be transparency and
accountability, that public money is being used effectively and the
authority is acting responsibly.

 

The factors against disclosure are that there are ongoing investigations
underway in relation to this establishment and release of the information
could prejudice such investigations. Disclosure of the information could
lead to more public money having to be spent if the release of the
information resulted in the collapse of any prosecution. It would
therefore be harmful to provide such confidential details into the public
domain under the FOIA at present.
