Although the University does hold some of this data, a more complete record should be available from the UK Border Agency (for example, I am advised that we do not have the information necessary to answer question 5, because we would not be informed that a visa had been refused, only that a CAS had been used). I note that you have sent this request to a number of UK universities: can I suggest that it may save you time, and result in a more complete set of data, if you contact the UKBA directly, making an FoI request to them as a public authority?

I am writing to request an internal review of University of Leeds's handling of my FOI request 'Tier 4'.

[ Under the Freedom of Information Act, you are liable to provide all the information as requested. You cannot forward the burden of information to some other organization body like UKBA. The information which has been requested are those information which should be always handy with the educational institution because these information needs to be reported to UKBA directly under the sponsorship duties. So I hope you would be able to reply me within the stipulated time.

Dear Ghavi,

To be clear, I was not refusing to provide any information, just trying to be helpful in suggesting that a more complete dataset might be available from the UKBA. As I hadn't heard any further from you, I had thought that you were exploring that option. Clearly that is not the case, however. I am perfectly happy to look at the request in more detail to see what data is held here, that's no problem whatsoever. The Act sets out a duty to assist; I was simply trying to do so.

I will get back to you as soon as possible to confirm what data is held. If, at that point, you have any reason to request a formal review of that response, I will, as a matter of course, include details of how to access the review procedure. Reviews are conducted by Mr David Wardle, the University Complaints Officer, rather than via me - I'm sure you'll appreciate that it's good practice for me to remain clearly outside a process that reviews my decisions and responses.

below the data that the University holds in relation to your questions
about CAS’s and Tier 4. The University does not hold any data that would
allow us to respond to questions 5 and 10 because we are not informed if a
visa has been refused; this data is held by the UK Border Agency.

 

I hope this is helpful in resolving your query. If you have any questions
