I am writing to respond to your Freedom of Information request of 21 March
regarding Tier 4. I have spoken to colleagues here who  deal with the Tier
4 process. They tell me that the information we hold is not sufficient to
answer most of your enquiry. In particular we are not informed if visa
applicants fail unless a student or applicant chooses to share that
information with us. My colleagues are also uncertain whether the systems
we have will enable us to answer questions 3 and 8 with a reasonable level
of confidence. Much of the information we would be able to supply would
need to be drawn from the UKBA’s system.

 

In light of all this I am suggesting that you might like to direct your
enquiry direct to the Home Office’s own FOI team. You can contact them on
[1][email address]. They will have fuller records than us.

 

Just to be clear: this is not a refusal as I believe we do hold some of
the information and could provide it for you. If you feel strongly that
you would like us to provide what information we can then of course we
will. My suggestion is that you will receive fuller and more accurate
information from the Home Office FOI team, and it will be easier for you
to compare that information across Universities. I do hope you find this
suggestion useful.

I am now writing to respond to your Freedom of Information request of 21
March 2012. I initially wrote to you suggesting that the UKBA would hold
more of the data that you wanted, in a way that would make it easier for
you to compare institutions, and that the FOI team there were aware of
your request and happy to deal with it. You have let me know that you
would rather not use this route. Although you have sent this response to
me in the form of an appeal I am not accepting it as such as my original
response was a suggestions rather than a refusal, as I explained at this
time. This means that you still have the right to appeal if you are not
happy with this response.

 

The information we are providing has been collated by cross-referencing
data we hold as an institution against that available to us from the
UKBA’s Sponsor Management System (SMS). This means that the answers
provided are influenced by the data held on the SMS at the point at which
the data has been downloaded and cross-referenced. It is worth noting that
the data held by the SMS is not 100% reliable: for example, we are aware
of several cases where visas have been issued but the status of the CAS
remains ‘ASSIGNED’ rather than ‘USED’. This is important because we cannot
report against ASSIGNED CAS, only USED CAS, and this affects the figures
we are able to give you.

 

In the earlier timeframe you are looking at (5 July and 30 September 2011)
we issued 1455 CAS of which 1216 were USED. Within the later timeframe (1
October 2011 and 31 January 2012) we issued 268 CAS of which 220 were
USED. Many of those issued but not USED will have been superseded by the
issue of a fresh CAS. It is currently University of Essex policy to assign
another CAS if the student updates their passport number or if any errors
are found to be noted on the original CAS. The UKBA does make provision
for us to report amendments but experience has shown that these are not
always picked up by the UKBA Entry Clearance Officers.

 

Within the earlier timeframe we issued 119 CASs that were USED, but where
the students themselves did not enrol at the University. In the later
timeframe 22 applicants fell into this category. This number will include
students who, on arrival in the UK, transferred to a different University.
All of those who failed to enrol were reported to the UKBA.

 

We are unable to supply an answer to your questions 5 and 10. The UKBA
does not require us to hold this information and we do not collect it.
Applicants with a CAS may be refused entry at the border and we would not
be notified of this. 

 

Just to be clear, I have provided information in response to all of your
questions, except questions 5 and 10 and that is not information that is
being withheld, it is information we do not hold. The UKBA will hold this
information and  I do suggest that you apply direct to them for it.
