Dear University of Aberdeen,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of University of Aberdeen's handling of my FOI request 'Tier 4'.

[ Under the Freedom of Information Act, you are liable to provide all the information as requested. You cannot forward the burden of information to some other organization body like UKBA. The information which has been requested are those information which should be always handy with the educational institution because these information needs to be reported to UKBA directly under the sponsorship duties. So I hope you would be able to reply me within the stipulated time.

I confirm , however, that our figures have been provided with the
following caveats:

·         We do not  accurately know the date on which a CAS was Assigned
for each of the periods ( Q1 & Q6) and  therefore identify which students
in these periods then converted to Used CAS status etc.  We cannot
therefore accurately  answer the remaining  related sub questions.

·         We do have data on which CAS were Used– which I have taken to
mean translated into a Visa being issued . There is no central University
source for this data however,  other than downloads from the UK Borders
Agency’s own system.

·         University administrative systems do not routinely hold data on
the date of issue or status of certificates issued by UKBA

·         University administrative systems do not  routinely hold data as
to whether certificates which have been assigned,  are used or a visa
refused.

·         We do not hold information to answer question 5 and 10 because
we are not informed by UKBA of visa refusals. This information is held by
the UK Border Agency.

The intention of our initial reply was not to “forward the burden”  onto
the UK Border Agency, but  to direct you to the UKBA in the spirit of
assisting you with  a more complete and  comprehensive answer.

The UKBA holds data for all UK institutions. The primary source for the
data sought in your request, comes from the Sponsor Management System,
managed by the UKBA. Universities have limited access to the system and
its data.

I have provided contact details for the UK Borders Agency, for reference
[2]http://www.ukba.homeoffice.gov.uk/naviga...

I hope this response will be satisfactory.

Should you be dissatisfied with the University's response under the Act,
you have the right to ask the University formally to review its decision.
If you ask us to do this such a review will normally be undertaken by a
senior member of staff with no prior involvement in the original
decision.  The University may, however, refer the matter to a lay member
of the University Court to undertake the review where this is deemed
appropriate.  Any request for review must be in writing or another form
capable of preservation, be received not later than 60 working days
following the date of your original request, as adjusted by the date of
this reply, and state the matter which gives rise to your
dissatisfaction.  It should be addressed to Mr B Purdon, Clerk to the
University Court, University Office, King's College, ABERDEEN AB24 3FX.

Yours sincerely,
