Tier 2 ICT Long stay eligibility

Dear Office of the Immigration Services Commissioner,

There is a guideline for UK Tier 2 ICT Long stay Visa that a person
can not return to UK as an ICT within 12 months of expiry of last
period of leave as an ICT. (Page 9 in
http://www.ukba.homeoffice.gov.uk/siteco...
).

However I had a Tier 2 Work permit (Not HSMP) issued in 2008 for 2
years and the Work permit got extended in 2010 for an year (with
the issuance of Resident permit) which expired in Sep 2010.

My Salary in UK would be more than 40 K GBP.
Since I never had an ICT, I think I am eligible for the 'UK Tier 2
ICT Long stay Visa' and the guideline above isn't applicable in my
case.

Please confirm.
