Dear Kent County Council,

In regards to the possible "three arm" roundabout at A229 Linton Hill / A229 Staplehurst Road / B2079 Maidstone Road. According to a developer's proposal document for a housing development in Marden, "this junction is proposed to be upgraded from a priority junction to a three-arm roundabout, increasing capacity and addressing congestion issues."

Please send me a copy of any documents related to this, including:
1. A copy of any communications between DHA Transport / DHA Planning and KCC;
2. A copy of any plans or proposals; and
3. A copy of any Transport Assessment or other viability assessments.

I am making this request under the EIR.

Please note that I have filed multiple EIR requests but they relate to different roads around Marden.

Yours faithfully,

David Windham

Dear Kent County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Three arm roundabout proposals'.

I do not believe this has been adequately assessed and am somewhat bemused by the Council's blase attitude to this EIR. You were able to provide me with copies of communications (redacted where necessary) for my other EIR request around 1 mile away from this scheme, and yet for this one there has been no attempt to provide any.

Please confirm, therefore, that by not providing this, it means that there has been NO communication nor correspondence on the proposed 'three arm roundabout on the A229' , between the proposers and KCC.

I find this difficult to believe, so am requesting an internal review as I don't believe this EIR has been assessed rigorously enough, if at all.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...

Yours faithfully,

David Windham

Dear Kent County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Three arm roundabout proposals'.

Thank you for taking the time to refer to my original request for an internal review. However, the reason(s) given for your refusal are invalid. I made this request under the EIR and therefore request that you provide me with the relevant sections and paragraphs under which you have made the refusal. Currently, there is no such information. I will need this in order to refer the matter to the ICO.

Dear Mr Windham,

Further to your email below, I can confirm that the reasons for refusal
that were quoted in the initial response to your request were upheld as
part of the Review, which is why they were not re-stated.

For your convenience I have attached a copy of the response KCC initially
sent to your enquiry, which should contain all of the information you need
should you decide that you wish to pursue this matter with the Information
Commissioner.

With kind regards,

Dear Kent County Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Three arm roundabout proposals'.

Firstly, this EIR request has been handled appallingly, not only was it massively overdue, but a lot of the information you claim to have provided, has not been provided.

Before I submit this to the ICO, I feel it would be appropriate to request that you review this again. Please also double check that all communications have been included here, as I still cannot see your response to my internal review.

All I am looking for is the information requested, or if it cannot be provided then an adequate explanation why. It should not take 3 months to receive this, COVID-19 or not.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...

Yours faithfully,

David Windham

Dear Mr Windham

Thank you for your email. I am sorry to hear that you are not happy with
how the EIR Request was handled and the subsequent review. You have
requested an Internal Review in your email below, however this has already
been carried out so the next step would be for you to refer your concerns
to the Information Commissioner if you remain unhappy. The Information
Commissioner oversees compliance with access to information legislation
including the Freedom of Information Act 2000, Environmental Information
Regulations 2004, Data Protection Act 2018 & General Data Protection
Regulation. Details of what you need to do, should you wish to, pursue
this course of action, are available from the Information Commissioner’s
website [1]https://ico.org.uk/make-a-complaint/, or you can phone the ICO
Helpline on 0303 123 1113.
