Dear Mr. Halloran
FREEDOM OF INFORMATION REQUEST REF: 2017-1607
I am responding to your request under the Freedom of Information Act 2000,
which we received on 19 October 2017, for information held by the Council.
Your request is as follows:
On page 8 of the last filed accounts there I a entry called "qualified
third party indemnity provisions for Directors.
My questions are as follows.
A. Who is the indemnifier
B. What is the cost and duration of the indemnity
C. What does the indemnity cover.
D. Are there any other officers of the company covered by this indemnity
or and other indemnity?
Your request was sent directly to Kensington & Chelsea Tenant Management
Organisation. KCTMO are not a public authority under the Freedom of
Information Act and therefore have no legal obligation to respond to FOI
requests.
However, KCTMO do hold information on behalf of the Council when this
information is related to their housing function and this information is
subject to the FOI Act.
The information you have requested is about KCTMO company business and not
their housing function so therefore, the information is not held by the
Council for the purposes of the legislation.
Complaints
I trust this has satisfied your request. Should you be unhappy with the
handling of your request, the Council has an internal complaints process
for handling FOIA complaints. Complaints are reviewed by the Chief
Solicitor and Monitoring Officer or her nominee. A form is available from
our website to lodge your complaint
[1]http://www.rbkc.gov.uk/councilanddemocra...
Please contact us if you do not have website access and we can provide you
with a copy of the form. Following this review, should you still be
unhappy with how your information request has been handled, you have a
further right to appeal to the Information Commissioner who is responsible
for ensuring compliance with FOIA.
Yours sincerely

Dear Yu, Robin: CP-ICT: RBKC,
Your response is disingenuous at least, KCTMO is involved with housing, it has created a subsidiary to deal with repairs.
KCTMO has no other function than to manage the housing stocks.
So review your earlier finding please.
Yours sincerely,
paul halloran
Dear Kensington and Chelsea TMO,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Kensington and Chelsea TMO's handling of my FOI request 'Third party indemnity'.It is my belief that you assessment of the status of KCTMO is wrong.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/t...
