Dear Jasmine,

Thank you for your recent Freedom of Information Requests submitted to the Trust, under the FOI reference number, 147.23-24 received on 6th June 2023, in which you requested information under the Freedom of Act 2000 (‘FOIA’).

Whilst I can confirm that the Trust may hold some of the information requested, I am writing to inform you that the Trust will not be complying with your request(s) for the following reasons:

Section 12 of the FOIA allows a public authority to refuse to comply with a request for information if doing so would exceed the ‘appropriate limit’, which for authorities such as ourselves is 18 hours.

Further, Section 12(4) permits public authorities to aggregate two or more requests where two or more requests for information are made to a public authority;

(a) by one person, or
(b) by different persons who appear to the public authority to be acting in concert or in pursuance of a campaign,

Having conducted some analysis of request, the Trust has assessed that your request(s) are either the same person or linked to the same ‘campaign’, therefore the Trust considers it reasonable to aggregate the requests. As answering these request(s) would far exceed the 18 hours, the Trust will not be complying with any of the requests at this stage. Your request is deemed to be part of a wider campaign to the NHS for one or more of the following reasons:

• Your request is similar or identical to requests that have received in a 60-day period.
• The structure of the request has been linked to requests that are part of the same campaign.
• You have made multiple requests over a short period for different subjects, lacking clear motive and purpose. These requests at have also been linked to other requestors exhibiting same behaviour.

In order to provide assistance, to help you rescope your request we would ask that you consider providing us with a single name / email address to correspond with in the first instance, so that we are not having to manage multiple applicants under the same campaign. Given the wide scope and volume of requests made as part of this campaign is it problematic to advise any further how to rescope your requests within the 18 hours threshold.

Please be advised that any new request received from yourself that are associated with this campaign within a 60 working day period from this refusal notice will not be acknowledged or responded to.

If you have any queries related to this refusal notice provided, please contact my office via [Walsall Healthcare NHS Trust request email] in the first instance. Should you have a complaint about the refusal notice or the handling of your request, please also contact my office to request a review of this. If having exhausted the Trusts internal process you are still dissatisfied, you are entitled to approach the Information Commissioner’s Office (ICO) and request an assessment of the manner in which the Trust has managed your request.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Walsall Healthcare NHS Trust's handling of my FOI request 'Theatre Management Related Freedom of Information Request'.

I do not agree with your use of Section 12 to refuse my request.

I am not part of a campaign, an individual who has submitted a request for information, from a public authority, who use public money.

I have only submitted one request and therefore, your reference to a number of requests made by me, is incorrect.
