Response to this request is long overdue. By law, under all circumstances, North Yorkshire Police and Crime Panel should have responded by now (details). You can complain by requesting an internal review.

Dear North Yorkshire Police and Crime Panel,

I send this FOI request to the Police, the District Auditor, DEFRA, the Local Government Ombudsman, Selby District Council, the Police and Crime Commissioner, the North Yorkshire Police and Crime Panel and Nigel Adams MP.

I refer all the above authorities to my previous FOI requests, made to establish whether or not Selby Area Internal Drainage Board, as a legal entity, knows of the damaging treatment of its piece workers 84 to date.

There are only two possibilities here ie: that the Board has ratified the piece workers’ damaging treatment 84 to date, in which case this is a “Civil matter,” or that the Board knows nothing of such treatment, in which case I ask you to explain how this could come about without serious criminal misconduct having taken place.

By ruling that this is indeed a “Civil matter” you must possess evidence on which to base this opinion. Such evidence must be in writing, as verbal comment and hearsay will not suffice here. I therefore ask you all to publish such written evidence to support your assertion that this is indeed a “Civil matter.” I also ask for an internal review to be made to ensure that this request is adequately answered.

Dear Mr Crooks,

I write in response to your further request to the North Yorkshire Police and Crime Panel ("the Panel") dated 15th April 2018, (N3772).

As advised in the previous response provided to you on 20th March 2018, under the Freedom of Information Act (the Act), we are unable to provide the information you require as the Panel has no remit or responsibility in relation to the Selby Internal Drainage Board (IDB). You have referred to your recent correspondence with the Police and Crime Commissioner's (PCC) office. The PCC similarly will have no remit around what is essentially an employment issue regarding an IDB and I note that Thomas Thorp, Policy and Scrutiny Manager, has endeavoured to explore with you alternative avenues for seeking information.

While there is therefore no further information that the Panel can provide you with under the Act, the following may be helpful by way of providing clarity on the lines of responsibility around this matter. The Selby IDB is a non-departmental public body with responsibilities to consider requests for recorded information under the Act. DEFRA is the central government department responsible for IDBs and similarly has responsibilities to consider requests for information under the Act. They are the appropriate points of contact for further requests in relation to the matters and concerns you raise. If you are not happy with the way that your requests under the Act have been handled, you may wish to seek an internal review from these bodies, which you should request within two months of receiving the authority's final response. Subsequently, if you still feel that your requests have not been dealt with appropriately, you have the right to contact the Information Commissioner's Office for further advice or assistance, via:
