The Shay Stadium Further Info

Dear Calderdale Metropolitan Borough Council,

Firstly, many thanks for the information provided in my previous request. This has been very helpful.

The information provided has created a number of further queries. Please see these below and treat this as a new request.

1. A blank copy of the contract provided to both FC Halifax Town and Halifax RLFC. This has historically been provided previously under FOI so I do not see any reason for exemption. This does not have to show any personal information (signatories etc). If you have an issue in providing the full contract, can I please request that specifically the clause around payment of rent is provided.

2. Any correspondence between the rugby and the Council that discusses the non payment of rent, the request for rent payments to be deferred and any agreements being made in referral to non payment of rent. Please note that I do not believe that all information held will be exempt under prejudice of commercial interests (section 43 (2)) or legal professional privilege (section 42 (2)). Much of the information held is in relation to how public money is being spent, and blanket exemptions on all information held should not be used in line with the Act.

3. A Copy of any CMBC policies or procedures held, that are used when council officers deal with non payment of rent relating to the use of council assets (such as the shay).

4. As Halifax RLFC are in arrears in payment of rent (as provided in your previous response) Please provide the reasons why the Rugby have been allowed to use a council asset and continue to do so when full rent has not been received? In many other cases the Council would have taken significant action against an individual or business for non payment so why has this issue being dealt with differently?
