"The Scrape", near to Gilroy Nature Park, West Kirby

The request was successful.

John H Hutchinson

Dear Wirral Metropolitan Borough Council,
With reference to the letter dated 9 December 2015 from Neil Thomas to the landowners, I shall be grateful if you can let us see the notices received in relation to the flooding of properties on Gilroy Road? Names and house numbers may be redacted for the sake of privacy.

To how many landowners were similar letters sent?

This request is necessary because Director of Regeneration has told me that he is too busy to reply substantively to my personal request for the information.

Yours faithfully,

John H Hutchinson

Dear Mr Hutchinson

Thank you for your recent request for an Internal Review of the Council’s
handling of your Freedom of Information request dated 1 November 2016.
Wirral Council apologises for failing to respond to your original enquiry
within the statutory timescale, necessitating your request for review, in
which you stated:-

“With reference to the letter dated 9 December 2015 from Neil Thomas to
the landowners, I shall be grateful if you can let us see the notices
received in relation to the flooding of properties on Gilroy Road?  Names
and house numbers may be redacted for the sake of privacy. To how many
landowners were similar letters sent?”

In response the Council can advise:

Your reference to ‘notices’ is unclear. Wirral Council received one
enquiry in relation to garden flooding at a property in Gilroy Road -
please see attached the original enquiry (November 2015)  and follow up
responses (through to May 2016).  Please note that some of this
information amounts to personal data which is exempt from disclosure under
Section 40 (2) of the Freedom of Information Act.   As disclosure of that
information would contravene the first data protection principle, that
personal data shall be processed fairly and lawfully, and shall not be
processed unless at least one of the conditions in Schedule 2 of the Data
Protection Act 1998 is met, this information has been redacted.

Responses were sent to the one property owner who made the original
enquiry.  Two landowners were sent letters as a consequence of the
reported flooding at Gilroy Road.

Yours sincerely
