(1) Any guidance held which explains the Office of the Chancellor of the Duchy of Lancaster. This would include for example documents describing the powers, functions and responsibilities associated with the Office.

(2) Any guidance held which explains the constitutional and/or legal status of the Duchy of Lancaster.

(3) Any guidance held on Queen's Consent in respect of the Queen's interest in the Duchy of Lancaster.

In line with your duty to advise and assist under Section 16 of the Act please also provide me with a list of briefing papers/files/other records relevant to understanding the Office of Chancellor of the Duchy and the Duchy itself to assist me in my research.

Dear FOI Team - Cabinet Office,
Thank you for your email of 16 October 2012 in which you refuse to answer my request for information on the basis that the Duchy of Lancaster is not named as a public authority in Schedule 1 of the Freedom of Information Act 2000 ("the Act").

My request was addressed not to the Duchy of Lancaster but rather to the Chancellor of the Duchy of Lancaster ("the Chancellor"). Schedule 1 of the Act includes as a public authority "Any government department". Section 84 of the Act defines the term government department as follows: “government department” includes a Northern Ireland department . . . and any other body or authority exercising statutory functions on behalf of the Crown"

The Chancellor of the Duchy of Lancaster is a government minister in his capacity as Chancellor (this is clear from Schedule 1 of the Ministerial and other Salaries Act 1975). The Chancellor is therefore part of the Government and furthermore the information he holds in his capacity as Chancellor can be requested under the Freedom of Information Act 2000 by making a request to the Government Department to which the Minister belongs or any representative thereof. This would include the right to address the request to any Minister of that Government Department such as the Chancellor himself. I made my request using contact details for the Office of the Leader of the House of Lords because that is the department to which the Chancellor belongs according to the following Cabinet Office webpage: http://www.cabinetoffice.gov.uk/content/...

Please can you confirm that the Chancellor or officials working on his behalf will be answering my request.

The title of Schedule 1 of the Ministerial and other Salaries Act 1975 has the title "Ministerial Salaries" and the list includes the Chancellor of the Duchy of Lancaster which makes it clear that this office is the office of a Government Minister.
