The 'real' breach of the law.

Dear British Waterways Board,
Could you enlighten me as to what constitutes the greater breach of the law. So-called (they have no choice) 'continuous cruisers' not engaging in a permanent, endless, pointless, continuous journey around the canal network, wasting fuel, wasting their time, wasting water (particularly in times of drought), being denied access to social and medical facilities to which they are legally entitled and being treated like refugees or fugitives from some myopic vision of acceptable normality - OR - forcing people with threats of legal action, and actual legal action, into 'moorings' in marinas that have no planning permission for residential use, where one has to live 'covertly', where conditions are unsuitable for residential use and which BW themselves state are unlawful and may be subject to enforcement action from Local Planning Authorities?

A pointless rant that BW can simply reject, as it is asking for opinion, not information.

Dear Mr Mayers,

I write further to your e-mail of 12 June 2011.

I have now read through your correspondence below and, although this is headed Freedom of Information Act, I understand that your request is not a request for “information” for the purpose of the Freedom of Information Act 2000.

Dear Information Request,
Please pass this reasonable request for an explanation to someone who can, and will, answer it. I've been through the complaints procedure regarding this and numerous other issues and know, and am used to, BW's obfuscation and refusal to answer questions they don,t like. Their answer is to say that I will have to take them to court which few of us are able to do. Fortunately they are taking me to court which I look forward to.

Your question asks BW to offer an opinion. FOI requires them to provide facts. It does not require them to engage in point scoring debates with people who have an axe to grind, because they believe that the law should be something other than what it actually is.

This is not a game. The purpose is to expose the serious abuses by BW by all means available with a view to getting rid of them and, hopefully, having them criminally prosecuted. Their refusal to answer questions is a good indication of their attitude. What I said is factual. What you say is opinion. You're not interested in the facts and I'm not interested in your opinion.

Mr Mayers:
Your original question simply attempted to drag BW into a debate. It was not a request for specific information and is clearly outside the scope of the FOI act.

Your continuing attempt to discuss the matter is clearly vexatious and an abuse of this website. By all means continue to feel aggrieved if you wish, but take your arguments elsewhere.

Mr Mayers,

You are quite clearly grandstanding and making vexatious FOI requests that fall way outside what FOI exists for.

If you honestly imagine that you are going to get anybody criminally prosecuted for the previously unheard of crime of "Failing to do whatever Geoff Mayers wants" you are deluded.
