The Public Authority Accountability Bill ( Hillsborough Law ) and more ..

Response to this request is long overdue. By law, under all circumstances, Wiltshire Police and Crime Commissioner should have responded by now (details). You can complain by requesting an internal review.

Dear Wiltshire Police and Crime Commissioner,

The Public Authority Accountability Bill ( Hillsborough Law ) is currently making its way through Parliament.

I wish to establish the Policies and Procedures you currently hold and use , and those held by Wiltshire Police themselves , to enable you to deal with any member of the public whose family member suffers death, or where an individual suffers life changing injuries due to the failings of a MAPPP or MAPPA or ' High Risk Panel ' process, or also ANY failing of a public authority that leads to a death or life changing injuries being sustained by a totally innocent member of the public ?

Please also provide all information or leaflets etc that you or Wiltshire Police hold regarding these matters , including anything that is held internally on how staff / officers must deal with these matters.

Would you also be kind enough to show me what current Legislation has been taken into account when preparing these policies / procedures / other information , and make me aware of what changes were made following the now Prime Minister Theresa May's intervention in the Hillsborough matters, where millions of pounds of public money was wasted on trying to cover up past and present failings ?

May I also be aware of how how the Wiltshire PCC and his staff, and Wiltshire Police support any 'vulnerable adult ' through these and other processes - what policies/procedures/Legislation/ Government guidance or requirements has been issued to ensure vulnerable people are adequately supported and receive Justice ?

I should advise you I am seeking a ' reasonable adjustment ' under Equality and DDA Legislation, to be provided here with ALL the information and documents you hold regarding these matters, here on the whatdotheyknow website please, as I am not computer literate due to multiple disabilities and being classed as a 'vulnerable adult'.

When acknowledging this request, if you are unable to provide the information and answers held by Wiltshire Police ( as I know them to be a separate public authority from yourselves, although I believe you both share the same FOIA staff within the one office ? ), will you please make me immediately aware of this fact if you are unable to provide information for both public bodies when responding ?

I have received an email this morning from the whatdotheyknow website stating " By Law, the Wiltshire Police and Crime Commissioner should have responded promptly and by 09 May 2017 . "

I understand from the ICO you MUST respond within 20 working days, and it is an offence not to.

Within your acknowledgement , you state " This request will be considered under the terms of the Freedom of Information Act 2000 " - I believe you have not complied with those terms ?

Your acknowledgement also states " .... you will receive a response within the " I believe a capital ' S ' is required ? " Statutory timescale of 20 working days as defined by the Act " .

I can confirm within the 20 working days, I have not been advised of any revised time scale , hence I believe this is a breach of the Freedom of Information Act by yourselves ?

I ask where the Law and my Rights are not being complied with by the Wiltshire Police and Crime Commissioner, that the Commissioner himself makes a public apology to me here on the whatdotheyknow website ,for each area where his office has failed to comply with the Act, and recognises the additional stress and upset this causes a vulnerable person , as he needs to take ownership and accountability when his office breaks the Law , and denies a member of the public his Rights.

NO other apology from staff members will be acceptable to me, as I often receive a meaningless and insincere apology from staff in other organisations who are neither responsible or accountable for the failings.

I am interested to see how seriously the WPCC treats this breach , especially in light of my being an elderly vulnerable adult who is disabled , who needs to rely on public sector workers to do what they must , and ensure I receive all of my Rights as a disabled person.

I am disappointed the OPCC appears NOT to have realised this request is about MUCH MORE than just the Public Authority Accountability Bill, and much closer scrutiny of my request by someone senior in your authority appears to be required - please pass this on to the Police and Crime Commissioner himself as it
appears to me this request is not being dealt with as it should be and requires his urgent attention ?

I am certain information relating to parts of my request will be held by , if not drawn up by and approved by the Solicitors and others and the Police and Crime Commissioner himself, and ask those handling my request for the Police and Crime Commissioner to deal with this request properly .

I am surprised my request has been passed to another public authority , and trust this is in the interests of a full and complete disclosure being provided ?

NO , I was not told my request was being passed to the Force Disclosure Unit, why not ?

When was it passed to the Force Disclosure Unit - may I please see the emails that transferred it ?
I understand the OPCC and the Force Disclosure unit are based in the same building , the same offices ?

You state I refer to a letter that was written to me by the force disclosure unit, to be clear I have only received the emails here - but not any letter from the force disclosure unit ? Please clarify ?

I wish the police and crime commissioner himself to respond clearly and truthfully without spin , to the matters raised in my first email of todays date , as previously requested for the reasons stated .

It is very upsetting and distressing when public authorities behave in this way towards the vulnerable, the elderly and disabled, especially where I have requested a ' reasonable adjustment ' due to my disabilities within the original request submitted to you ? Clearly this too requires the urgent attention of the PCC please.

A few minutes ago , I sent you an email at 15.57 and have since received and email from your office timed at 15.54 , It appears within your email , you were referring to a letter that had not been sent at the time of your sending me your email, but was sent to me afterwards when I was emailing you , hence my not understanding
when you told me about a letter that had not at that time been sent ( by email ).

Mr Elliss' letter does not supply any information or response .

I am sorry I am not receiving a fair or competent level of service that complies with Legislation and my Rights, and with your duties to me as a vulnerable disabled adult - this is all very painful.

I AGAIN ask for Angus McPherson , the Police and Crime Commissioner to become personally involved
and respond personally to the matters I have already raised ? Failures within your offices are causing me damage and distress , and the Law is being broken _ I want YOUR response Mr McPherson please ?

Thank you for your email of 10 May here , following my FOIA request being eventually passed to you from the Wiltshire OPCC offices.

Would you please be kind enough to confirm you have been passed my entire request, and are continuing with your endeavours ?

A proper full response is VERY important to me , along with a detailed response under ' the Right to know '
of the FOIA , I am aware that a senior solicitor in the OPCC office that has again involved himself , in this matter may wish to deny me my full Rights and cover this matter up, and trust you are able to act fairly and impartially in your handling of this request ?

I am in receipt of your email to me on the whatdotheyknow website dated 12 May 2017.

Your email missed off my request for a ' reasonable adjustment ' under Equality and DDA ( Disability Discrimination Act ) Legislation - and I believe further Legislation exists to ensure I receive ALL of my Rights - although this appears not to be happening within the office of Wiltshire OPCC ?

I am sure you are aware, as a prominent Legal figure in Wiltshires policing over many many years - dating back to the early 2000s I believe ? , you will be aware of my need for making this request following your earlier correspondence with me MANY years ago when you failed to resolve matters ?

I believe I should ask YOU for S16 assistance too, and also for a detailed response under the Right to know
part of the FOIA please, as I was seriously injured many years ago and remain VERY ill now ?

I must complain at YOUR poor handling of my request, the apparent lack of the ' reasonable adjustment ' I requested, and I would of expected in light of the content of my request - a senior member of staff would have contacted me in this instance to discuss the matters being raised by an elderly disabled vulnerable adult , who needs proper support to resolve long term injuries ?

You are now again formally aware of some of the facts , in a format that cannot be shredded as maybe happened before, so I expect you to act promptly now,as you should have many years ago ?

I am aware one of the ' mind games ' being played on the mentally ill vulnerable and disabled ( one of may forms of abuse I believe ) is to ensure the senior leading figures in a number of public bodies are ' protected ' from the truth where proper records of VERY serious matters being reported are being kept from the most senior figures , even being watered down, altered or deleted altogether .

Is the role of the Wiltshire OPCC and yourself Kieran Kilgallen to serve the public and do the Right thing,
or to cover everything up for all your career is worth ? I would like to formally know what type of public sector organisation I am dealing with please - to be helped or to be subjected to even more multiple acts of abuse and cover up that continue to seriously harm me ?

Should I expect the Truth, the Whole Truth and Nothing but The Truth from Wiltshire OPCC , or is there no chance of my receiving that level of service ?

I trust you have the ability to correctly prioritise my needs from your service, in a timely manner now ?
