I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

The details we require are:
• What are the contractual performance KPI's for this contract?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract (and any sub lots), from the start of the contract to the current date
• Start date & duration of contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the contract and, if so, the duration of the extension?
• Has a decision been made yet on whether the contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

Question :Actual spend on this contract (and any sub lots), from the start of the contract to the current date

Answer: 

This information is exempt under Section 43 (Commercial interests) of the Freedom of Information Act 2000 (“the Act”). The
part of the Act which we are relying on is as follows:

43 Commercial interests. (2) Information is exempt information if its disclosure under this Act would, or would be likely to,
prejudice the commercial interests of any person (including the public authority holding it).

As this exemption is a “qualified” exemption rather than an “absolute” exemption, we have provided details of the prejudice
and public interest tests below which outline the factors underpinning our decision to exempt this information.

Prejudice Test

Releasing the Actual spend on this contract would prejudice the negotiating position of the council in future contractual
negotiations with potential providers.

It could weaken SMBC's or a third party’s position in a competitive environment by revealing market-sensitive information or
information of potential usefulness

to competitors; and 

Weaken SMBC's bargaining position with suppliers of goods and services Public Interest Test

Public Interest Test

Public interest factors in favour of disclosing the information:

Releasing the information would provide a significant extent of transparency about the Council’s public services and the use
of its finances.  

Public interest factors in favour of maintaining the exemption:

We want companies to feel confident in engaging with the SMBC commercially and in providing it with commercially sensitive
information;  

That SMBC maintains a strong bargaining position during contractual negotiations in order to ensure that the funds are spent
effectively; and 

That the competitive position of companies in their particular market is not disadvantaged by doing business with SMBC. It
would not be in the public interest to disclose sensitive information about complex care providers if that information would
be likely to be used by competitors to gain a competitive advantage.

We conclude that it is appropriate to apply to Section 43 exemption to commercially sensitive information in answer to this
particular question for actual spend on this contract. 

Further information including who current providers are can be found via the Councils contracts register, however this does
not list the amount of funding that provider has received.

Option to extend: 24 months in annual increments
