1. Please, provide a full copy of the guidance: “The Provision of Equipment into Care Homes 2004 - Reference: HSC 2003/006: LAC(2003)7”.
Comment: certain NHS Community Wheelchair Services (WCS) mention this guidance, however without providing a link or PDF copy. This guidance is cited by certain NHS WCSs to justify that care homes should fund certain types of wheelchairs (without specifying which).
2. Does the above guidance have statutory force?
3. Does this guidance constrain care homes to provide wheelchairs free of charge, as would the local NHS WCS?
Comment: for information, any wheelchair provided by a care home is charged to the residents in their monthly fees.
4. Is the guidance “The Provision of Equipment into Care Homes 2004 - Reference: HSC 2003/006: LAC(2003)7” still in force in the light of the publication of another guidance in 2022: “Guidance on the legal rights to have personal health budgets and personal wheelchair budgets”?

5. Does NHS England and DHSC know of any restrictions on the legal right to have a personal wheelchair budget, applying to residents in care homes?
