We're waiting for Ryan Jarvis to read a recent response and update the status.

Dear Essex Police,

I am writing to respectfully make a request in accordance with the Freedom of Information Act 2000. My request is as follows:-

1) Please, can you provide a list of all employee roles who are employed by your authority and are subject to the provisions as set out in the Official Secrets Acts 1911-1989?

This can be provided in any format, however, a spreadsheet detailing each role and a mark as to whether the role requires the role holder to sign a declaration as to their recognition of being bound thus required to comply with the Act(s).

2) Please provide a disclosure of the format used by your authority which requires the signature of any role holder who is subject to provisions as set out in the Official Secrets Acts 1911-1989 such as an "Official Secrets Acts & Confidentiality Declaration"

Under the Freedom of Information Act we are required to reply within 20
working days.  The Act does not specify a limit to the number of
information requests a public authority may receive or the number of
requests or questions an applicant may submit.  However, there are
exemptions in the Act that can apply and these include where the cost of
complying with the request would extend beyond the reasonable cost limit,
(currently 18 hours or £450), or if the request is otherwise manifestly
unreasonable in its scope or nature.

 

Requests that ask a great many questions, or a number of detailed requests
submitted at the same time, may make it necessary for Essex Police to
refuse the requests wholly or in part. The exemption at section 14 may be
engaged if the burden on the authority is increased through multiple
requests on differing subjects.

 

The Information Commissioner’s Office (ICO) has responsibility for
providing oversight and guidance for the legislation and they have
produced advice for applicants on submitting effective requests.  Further

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties
on public authorities. Unless exemptions apply, the first duty at Section
1(1)(a) is to confirm or deny whether the information specified in a
request is held. The second duty at Section 1(1)(b) is to disclose
information that has been confirmed as being held. Where exemptions are
relied upon Section 17 of FOIA requires that we provide the applicant with
a notice which: a) states that fact b) specifies the exemption(s) in
question and c) states (if that would not otherwise be apparent) why the
exemption applies.

 

In respect of your enquiry:

Having completed enquiries within Essex Police in respect of Section
1(1)(a), Essex Police does hold information relating to your request.
Under Section 1(1)(b) the below and attached have been provided in
relation to your request:

 

All Essex Police Support Staff roles require the role holder to sign the
Official Secrets Act 1989. Please find attached, a copy of the
declaration.

 

With regards to Police Officers, nothing is sent to Police Officer
recruits in their joiner information. However, below is an extract from
the legislation
([1]http://www.legislation.gov.uk/ukpga/1989...), which states:

 

S 12(1)e “any constable and any other person employed or appointed in or
for the purposes of any police force [F5(including the Police Service of
Northern Ireland and the Police Service of Northern Ireland Reserve)][F6
or ][F7 an NCA special (within the meaning of Part 1 of the Crime and
Courts Act 2013) ]”

 

Also, any individual who does not go through the recruitment process i.e.
contractors, volunteers, partner agencies, etc all have to be vetted and
sign a declaration, which includes the below statement:

 

Official Secrets Act 1911 – 1989;

 

Contractors and Volunteers – I have been informed that information,
documents or other articles protected against disclosure by the provisions
of the Official Secrets Act (for example relating to the prevention and
detection of offences) will come into my possession in circumstances
requiring it to be held in confidence. I understand that I may be
prosecuted for an offence under the Official Secrets Acts 1911 – 1989
should I disclose without lawful authority any such information, documents
or other articles.
