Dear Bolton Safeguarding Children Board,

I am writing to respectfully make a request in accordance with the Freedom of Information Act 2000. My request is as follows:-

1) Please, can you provide a list of all employee roles who are employed by your authority and are subject to the provisions as set out in the Official Secrets Acts 1911-1989?

This can be provided in any format, however, a spreadsheet detailing each role and a mark as to whether the role requires the role holder to sign a declaration as to their recognition of being bound thus required to comply with the Act(s).

2) Please provide a disclosure of the format used by your authority which requires the signature of any role holder who is subject to provisions as set out in the Official Secrets Acts 1911-1989 such as an "Official Secrets Acts & Confidentiality Declaration"

Dear Mr Jarvis

 

I write further to your request for information received on Tuesday 19^th
November 2019 and which was addressed to Bolton Safeguarding Children
Board.

 

You requested:

 

 1. Please, can you provide a list of all employee roles who are employed
by your authority and are subject to the provisions as set out in the
Official Secrets Acts 1911-1989?

 2. Please provide a disclosure of the format used by your authority which
requires the signature of any role holder who is subject to provisions
as set out in the Official Secrets Acts 1911-1989 such as an "Official
Secrets Acts & Confidentiality Declaration"

 

Bolton Safeguarding Children Board has been dis-established in accordance
with legislative requirements contained in the Children and Social Work
Act 2017; the Board and its associated functions fully ceased on Monday
30^th September 2019.

 

New multi-agency arrangements are in place in the form of Bolton
Safeguarding Children Partnership, led by three statutory partners: Bolton
Clinical Commissioning Group, Bolton Council and Greater Manchester
Police.

 

Therefore, in order for us to process your request, please would you
clarify whether you are seeking information in relation to Bolton Council,
or in relation to the Bolton Safeguarding Children Partnership? 

 

If you are seeking information regarding the Partnership, please confirm
whether you are seeking information just in relation to their role within
the Partnership.  Members of the Partnership come from different agencies
so it may be that an individual was subject to the provisions of the
Official Secrets Acts 1911-1989 in relation to their substantive roles,
but not in relation to their role within the Partnership.

 

If we do not receive clarification within 2 months of the date of this
email we will assume that you no longer wish to pursue the request and
will close it on our system.

RESPONSE – N/A, staff employed to support the multi-agency safeguarding
arrangements in Bolton are not subject to the Official Secrets Act

set out in the Official Secrets Acts 1911-1989 such as an "Official
Secrets Acts & Confidentiality Declaration"

RESPONSE – N/A

If you are unhappy about how we have dealt with your request please let me
know and I will refer the matter to the partnership lead for information
governance.  You also have the right to appeal directly to the Information
Commissioner’s Office (ICO), although please note the ICO usually expects
the local partners to have investigated your concerns first.
