Dear Sir/ Madam

Thank you for your correspondence of 13 April 2015 in which you made a
request for information to the ICO.
 
Your request read:” Could you give me any laws, regulations , official
documents or cases to show that UK is compatible with the maximum
disclosure principle of FOI legislation?”
 
We are writing to seek clarification of your request. It is not clear what
information you are seeking and what you mean by “the maximum disclosure
principle of FOI legislation”. We would be grateful if you could provide
further clarification to allow us to start processing your request.

Please note that section 1(3) of the FOIA stipulates that, where an
authority has informed the requester that it requires clarification, it
will not be under any further obligation to comply until the requester
supplies the information it requires. As such we will be grateful for
clarification at your earliest convenience to allow us to start processing
your request. Your case will be closed pending the receipt of your
clarification.
 
 
 It may be helpful to explain that the Freedom of Information Act covers
any recorded information that is held by a public authority in England,
Wales and Northern Ireland, and by UK-wide public authorities based in
Scotland. Information held by Scottish public authorities is covered by
Scotland’s own Freedom of Information (Scotland) Act 2002.
 
The ICO guidance states “everybody has a right to access official
information. Disclosure of information should be the default – in other
words, information should be kept private only when there is a good reason
and it is permitted by the Act;”

However authorities can refuse an entire request under the following
circumstances:
 

* It would cost too much or take too much staff time to deal with the
request.
* The request is vexatious.
* The request repeats a previous request from the same person.

 
In addition, the Freedom of Information Act contains a number of
exemptions that allow a Public Authority to withhold information from a
requester. The ICO has a general duty to investigate complaints from
members of the public who believe that an authority has failed to respond
correctly to a request for information.
